ZZPS letter after 'successful appeal'

I received a PCN in December for parking in a permit holders area of a hospital.

I appealed through POPLA and received an email 28th Feb stating 'Indigo Park Services have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.' After this, I thought nothing of it.

However, i'm mostly sure I appealed after the deadline, but as my appeal submitted fine, and POPLA sent me the successful appeal email, I thought that I was OK.

Today I got home from work and had a letter from ZZPS saying the unpaid PCN had been passed to them (originally £40, now plus £70 admin fee). I called them (before coming back here to check, I'm an idiot and i'm sorry) and said I had an email from POPLA saying I didn't need to pay. ZZPS said to forward the email on, which I haven't done.

Instead, I logged onto to POPLA to track my appeal, and it said this;
"Appeal has been withdrawn by the operator
Withdrawn on 28/02/2019

Verification Code
**********

Withdrawal reasons
This is no longer our contract so we are no longer pursuing debts due."

It seems Indigo withdrew their case as it had already been passed on. Today , 21st March, is the first I've heard of this since the 28th Feb.

Should I just ignore ZZPS, forward them POPLA email, or something else?


Sorry for creating a new post, a few searches didn't seem to yield anything like this. And thank you all in advance.

    yes IGNORE them both , but also email the BPA AOS team and report them both for a breach of the BPA CoP

    Oh please report them! Obnoxious swine that they are. Don't just breathe a big sigh of relief & leave it at that.

    And make sure you do not delete that email (I'm sure you won't!).

  • Thanks for the speedy replies everyone, I really appreciate it.

    My biggest concern is that i'm sure my POPLA appeal was after the 28 days required by Indigo (after my initial appeal to them).
    Will this be a loop hole used against me, as they could say my appeal is void as it was submitted late?

    And as for reporting them, should I just say I had a successful appeal email and nearly a month later received a letter fro a 3rd party debt collector? Should I include all the reference numbers I have?

    I am most definitely keeping the email, and I have a screen shot of the POPLA website showing my appeals progress.

    PoPLA codes last 32 days, so if you were inside that timeframe the appeal would have been accepted.

    Stop worrying!

    I do POPLA appeals routinely for people, on day 32 all the time.

    As long as the POPLA code worked, and it clearly did, you appealed in time.

    Complain to STEVE CLARK at the BPA about Indigo passing this to ZZPS despite the fact that 3 weeks ago they ducked out of the POPLA appeal, saying that they are no longer pursuing 'debts' for that site as they were (one surmises) finally kicked out:

    Do not use the generic AOS email for the BPA, or you will get one of the team of fob off merchants, sadly.

    Put this evidence to Steve Clark direct. Attach the ZZPS letter and the screenshot of the POPLA win/Indigo's excuses for weaseling out.

    Indigo turned down my initial appeal - 10th Jan
    My POPLA appeal submitted - 11th Feb
    POPLA upheld my appeal - 28th Feb
    ZZPS sent me a letter - 21st March

    It seems I was bang on day 32, lucky me.

    I will compose an email to Steve Clark, and send all the correspondence I have.

    Thanks again for all the replies, it really has put my mind at ease.
    It's not the money side that worries me so much, it's the fact these companies get away with it, and a win for the little guys is always a good thing.
    I'll update this thread once I've emailed Steve Clark, and follow up with any replies.

    yuo could hold tight, and see if you get anything else - keep everything, and print that email out, if you know how to get the email headers get them as well, computers etc have a nasty habit of going wrong at the worst possible moment.


    If you get anything else complain to PALs remind them of the NHS parking principles and you are taking this as harassment/misuse of data.
    Also ask PALs about patient confidentiality, as you may wish to keep hospital visits private, as they have a contractor ( the parking company) writing to / contacting a vehicles registered keeper who may not be the patient, and the patient may not want the Registered keeper to know they have visited the hospital

    Steve Clark and the BPA must now do something about their scammers.

    In the new government code of practice, it's not just PPC's who will be on the line, it's ATA's as well.

    The BPA is an unwanted dinosaur who would struggle without membership fees from their approved scammers
