Horizon Parking PCN

Evening all,

Received a PCN through the post from Horizon Parking claiming the driver had over stayed. However, the driver had visited twice not once and both times they did not over stay the time limit. But on the PCN it shows when the driver entered on the first visit and when the driver left on the second visit. Obviously it is their fault so they will be appealing. Any help with the appeal letter will be much appreciated.

    What do you mean the PCN should have POFA? Do you mean it should comply with POFA?

    It only needs to comply if they want to hold the registered keeper liable for the charge.

    Send the template you've found. Send it completely unaltered.

    Firstly - please edit your post so that it is not obvious who was driving.

    Next up - if you've read the NEWBIES thread, you know that you need to appeal using the blue template in post #1. Don't forget a complaint to the landowner/shop.

    You need to read POFA and check it against what your PCN says. POFA isn't a "thing", it's the Protection of Freedoms Act 2012, and you're looking for Schedule 4. You're looking to see whether they have met the set of criteria.

  • Get photos of the signs.
    Just in case they change them.

    My 2 local supermarkets have recently erected new signage, one stating no return within 2 hours and the other 4 hours.

    BTW if this was in a supermarket car park have you approached the store manager or the CEO requesting cancellation for a regular valued customer?

    and complain to your MP

    On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
