Advice needed for "free item" not received

Hi, I purchased a Samsung TV in December which advertised that you could claim a free phone (phone model depended on which TV was purchased)


As my phone had just broken, I decided to buy this specific TV to receive the free phone. I filled the online form in and the claim was validated. it said they aimed to have phones sent out within 2 days but it would be 30 working days maximum. its now been over 13 weeks since the claim was validated. Still no phone. Every email i send is replied with the same thing, they had a large demand of the promotion and have no idea when the phone will be sent.

Is there anything I can do? Im unsure with it being a "free" item if i have any rights as such? Thank you.

    Well it would really depend on how it was advertised and what exactly was said/promised at the time you entered the contract.

    But the phone wasn't free. At no added cost maybe, but not free. Else I (and everyone else who didn't buy that model of tv) would be able to get one too.

    I think these places protect themselves by putting clauses in the terms such as "while stocks last" etc. You have to check the terms, but if part of your contract is that this phone is provided with it then it sounds like they have broken their contract with you. If it's part of your contract then anything in that contract would have to be delivered within a reasonable amount of time and if they don't then you should be able to send the TV back for a full refund. Double check with citizen's advice as they are probably the best people to speak to.
