Popla help

Hi all,

Apologies if this post offends any one but ive been searching for the answer and cant find it.

So i received a ticket through the post from total parking solutions stating i had been seen to park my car then left the premises against their terms.

I wrote back to them stating i had no recollection of this and could the provide evidence of the contravention and if not cancel the ticket. So they simply wrote back rejecting my appeal and providing a popla number.

Before conracting popla i made a SARs request to TPS and they provided all info and there is no proof of the contravention.

I completed the popla appeal stating the contravention did not take place and despite requesting proof TPS have none. TPS replied with no proof just that id been seen by an attendant.

I got the popla decision and they have upheld the charge. Im totally flabbergasted, surely they have just given notice to TPS to ticket anyone should they wish for leaving site and they will have to pay.

Do i have any other options now or do i have to swallow this and pay it. The car is im my mrs name and we have a diddy baby so the stress of court is not an option.

    Hiya,


    I have read as much as i am able to at work and dont have the required time at home looking after our little one. On the first page of the thread there are circa 10,000 words or 34 pages- I even copied it in to word to try and buy some more time to read at work.



    I think my post was more hoping for a quick answer to whether i can resolve this without going to court. I have no problem with that process but my other half gets anxious over everything at the moment due to the new baby and it really isn't an option.



    If there isnt an answer or a direction i can be pointed then that's fine.

    the answer is glaringly simple

    its either , PAY , or fight a court case (if TPS start one within 6 years)

    aand a landowner cancellation is ALWAYS the best option, regardless of the above

    its an unpaid INVOICE, if you do not pay it or refuse to pay it , the PPC has the right to take it to your local civil court , regardsless of what you would like

    and you have the right to defend yourself against this invoice , before a judge , in that court

    YOU are not in control of this UNLESS you decide to pay , IN FULL

    THE COURT CASE WILL CERTAINLY KEEP YOU BUSY

    Thank you for that, i had a feeling that would be the case but appreciate you taking the time to confirm it.



    I will try the landowner, even if my only success is to put a complaint in to them highlighting the shoddy practices of TPS. I think i'm just dumbfounded that POPLA ruled against me despite TPS not having a shred of proof that I left the premises, which i did not.



    Anyway onwards and upwards, thank you once again.

    In their evidence to POPLA, which you will have seen, what was their proof or actual evidence?

    What did the POPLA assessor say about the point you raised about denying the claim of leaving?

    Hardly PROOF is it? If this got as far as court, the OP should call the attendant as a witness so he/she could be questioned as to why he/she did not advise the OP against leaving the site, especially as it seems to be so important to the PPC.
