Back to the OP, as it stands, as others have said, your only recourse is to the buyer. Personally I'd just try making it easy initially and ask when you would be able to collect your machine and then arrange to do so..0 -
I was wondering the same thing. I can well understand losing a "not as described" case, I'd be a bit hacked off buying a washing machine and it ending up as a dishwasher.

I agree, a polite 'when can I collect my widget please' (whatever it is) often works wonders- my concern is as F & L suggests this was best done at the time it occurred, delaying this is likely to be causing more issues. This isn't something you can afford to just put aside for a couple of weeks and hope for the best.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I have been advised by Citizens advice Consumer Services ( 0345 040506) that , as a private seller, I am not protected by the distance selling regulations but bound by Ebay and Paypal Terms and condition's . Therefor I cannot enforce the return of the dishwasher.
As a result I have
Had the purchase payment taken from me
Lost the dishwasher
Paid eBay £25.00 for the privilege .
If anyone has further information or advice it would be greatly appreciated .
Thanks Tim
But surely as an individual and not a business, you could make a claim in the small claims court because they are witholding your property?? How can this be allowed? Do ebay and paypal terms say that buyers can keep items if a case is found in their favour?! That is an awfully unfair term on the seller and means no protection for fraudulent cases. In all honesty I'd threaten the buyer with court action anyway as it may scare them into giving the washing machine back to you. A polite email is well and good, but they don't seem to be co-operating.0
