Lowell Default

Options
Hello,

Dont know if im in the right location.

I received a letter from Lowell the other surrounding a debt of over £2000 that has now defaulted. I had no knowledge of anything in relation to this.

Upon contacting, Lowell it turns out that a Very account was made in my name with a different address. I have also become aware that it was my ex partner that made the account in my name with their address without my knowledge. I spoke to my ex partner and they have sent emails and made telephone calls to Lowell, Lowell's CEO James Cromwell (email address found on here) Very and the 3 CRA's admitting that it was them that set up the account without my knowledge.

Lowell have said that they have sent an investigation to Very. So basically, my question is, as someone has admitted liability and indicated to everyone that it was them and not me that set up the account, will this default be removed from my credit file?

Any help would be greatly appreciated.

Have you reported this to the police and obtained a crime reference number?

Clearly if fraud has been committed against you then the default will be removed in due course, the ex pursued by Very for the money and/or a conviction & payment via the courts, civil or criminal.
  • Yes, I have reported this to Action Fraud and received a crime reference number which has also been passed onto all of the above companies. Will this resolve the matter quickly as I do not want to have the default on my credit file as it was not me.
  • You just need to wait now.

If indeed it is found to be fraud then it should get removed from your files
  • Does anyone know if Lowell and the other companies will investigate now or do they need to wait until Action Fraud have completed an investigation. I have read some places that Action Fraud either take many months to deal with the matter and/or it does not even get looked into.

I just hope it helps that my ex partner has admitted to this and has subsequently contacted Lowell and Very by phone and e-mail and they don't need to wait for Action Fraud to complete.
  • UPDATE:

Lowell have contacted me and advised that the complaint has been escalated and will be looked at by some sort of Manager tomorrow. I should then here back in the next couple of days.

I am hopeful of having the matter resolved as my ex has literally phoned them and said that the account was totally made without their knowledge (they have confirmed phonecalls). I just don't see with that kind of statement that they can subsequently turn around to me and say that I am still liable.

I am assuming if I am not found to be liable then it will subsequently be removed from my credit file.
  • Yes it will be removed
  • Thank you for your help Gary! Upon looking through various posts your name has popped up a few times with some helpful information.

If it is found fraud is involved (which they should) as the person has admitted it, I am assuming they LEGALLY have to remove the default.
  • Yes any reference to it will be removed from your credit files
