The NEWBIES thread has ONE template appeal. It's not difficult to get this cancelled.

No PoFA warning means it has failed to meet the requirements of said act of parliament, so they cannot hold the keeper liable.
In addition, if ANPR was used, the NTK is also too late for the keeper to be liable. Both should be mentioned if/when it gets to PoPLA.

The above does not apply if the driver's identity is revealed, which is why you must not let this happen under any circumstances.

We know.

There is no need to go over this again. Smart do not use the POFA and this is stated on every Smart thread.

No need for any more posts stating the same, although we know it's new for you.

Put the words Smart POFA into 'search this forum' and just submit the template from the NEWBIES thread. It needs no alteration and NOTHING added about the POFA.

they may have realised that they have failed POFA and omitted the paragraph , or they fail to use it completely , regardless of the outcome

in any case, follow my instructions above, using the template as KEEPER

your edits are now ok for the posts I mentioned, so think before you post online, keep it ambiguous , keep it anonymous, ie: KEEPER & DRIVER

let us know if they cancel or if they refuse the appeal and issue a POPLA code

if they do the latter, see post #3 of that same NEWBIES thread, reading the golden ticket ones especially
