Help with Mutual Unpaid Item Dispute

Had a non paying bidder who was very apologetic and paid my relisting fees so I could relist the item immediately so I did a mutual dispute to get my final value fees back, but it is now 8 days since I opened it and no reply.

Ebay help pages say:

"Sellers can report an Unpaid Item up to 45 days after the transaction date (i.e. the date when the buyer commits to buying the item and the seller commits to selling it). Usually the seller must wait seven days after a listing closes to file an Unpaid Item Dispute. However, in the following exceptional cases, the seller can file a dispute immediately:
  • At the time of the filing the buyer is no longer a registered user of eBay.
  • The seller and buyer wish to mutually withdraw from the transaction.
In the first case the buyer will receive an Unpaid Item strike and the seller will receive a Final Value Fee credit without any additional steps.
In the second case the seller must file the dispute for mutual withdrawal. If the buyer responds to the dispute and agrees, the seller will receive a Final Value Fee credit and no strike will be given to the buyer. If the buyer fails to respond, the seller can still close the dispute to receive a Final Value Fee credit, and the buyer will not receive an Unpaid Item strike."

I have no option to close the dispute though?

I emailed ebay and they replied with:

"You need to close the dispute and choose the appropriate resolution
option before we credit your Final Value Fee.

You can close the dispute since the buyer doesn't respond within seven
days. If you don't close the dispute within 60 days of the end of the
listing, it will be closed automatically without a credit.

Here's how to close the dispute and claim your Final Value Fee:

1. Sign in to My eBay. Scroll down and click "Dispute Console" on the
left-hand side.
2. Click on the "Unpaid Items" tab, find the item and click "View
Dispute".
3. On the next page select the appropriate option:

- "We've agreed not to complete the transaction"
This option means you and the buyer have agreed to withdraw from the
transaction. You will receive a Final Value Fee credit but the buyer
will not receive an Unpaid Item strike.
Please note that we'll send an
email to the buyer asking them to confirm their withdrawal from the
purchase. If they don't agree, you won't get a Final Value Fee credit.
"

I do not have the option to close this dispute due to no response from the buyer.

Ebay help pages say if there is no response I can get a final value fee credit but the person who replied to the email first says i would receive a final value fee credit and then says if they don't agree i won't get a final value fee credit.

They haven't agreed or disagreed, just no response. I'm confused. Are the ebay help pages wrong?

    You should raise an item not paid dispute, not a mutually agreed not to proceed. Then you will have the option to unilaterally close

    Unfortunately it is not possible to open a second dispute once you have opted to go for a mutual.

    OP- after 8 full days from starting the mutual you should get the option to close it..so maybe you are a few hours too early yet?

    normally in an unpaid item dispute the options are there but you just can't select some of them until 8 days are up

    but in this mutual dispute there are no options to close the dispute, there are no options whatsoever, no wording, nothing to click on, just nothing

    unless they are suddenly going to appear in a couple of hours?

    just had an email to say the dispute is closed, buyer must have agreed to it
