Good Afternoon
I have raised a complaint with the solicitors we used during our property purchase. I have now received their final response with a small cheque for any "distress". I am planning on escalating to the Legal Ombudsman, can I cash the cheque?

Can you provide context; it will help people to advise accordingly.
Depending on the wording in the letter the offer may be in full and final settlement0 -
It says "We wish to offer the sum of £xx towards your distress as a gesture of goodwill and in full and final settlement"
It states that the letter is the firm's final response and states that if I remain unhappy I can refer to the Legal Ombudsman.0 -

In which case don't cash it.
BUT that said, it may be a perfectly valid offer.
What happened and how much are they offering?0 -
We raised a specific enquiry, to which they confirmed that it had been answered "satisfactorily". Exchange, completion etc happened.
A problem occurred with the part of the property that the enquiry related to. We assumed that the sellers had not answered this enquiry truthfully.
4 days of being promised call backs from the solicitor and promises of copies of the actual response, I finally received the answer to the enquiry, and it wasn't as we were lead to believe by the solicitor.
To rectify the issue has cost £3000, and the solicitors have offered £250. If we had known the answer we wouldn't have proceeded with the purchase.0 -
Cashing the cheque effectively means you accept the settlement. If you are not happy (and that seems to be the case) then do not cash it.0
