Assaulted twice in a shared house

Hi everyone,

I don't usually post here but I wanted to tell everyone about my current situation and see if the community here would be able to help at all as I am getting no where.

I have lived in shared accommodation for 3 years at the same address and since living here I have had nothing but problems with an abusive alcoholic lady who lives upstairs. Not just me several other people have moved out because of her too. In January she assaulted both me and my partner punching my girlfriend and putting her hands round my throat for which she spent the night in the police station. A couple of days later she ran at me and grabbed me by my face when my girlfriend wasn't here as she doesn't live with me. She got arrested again and went to court the next day to enter a plea. She admitted everything so I didn't need to attend court. She was then told to attend court on the 26th february for sentencing but turned up late so they moved the court date till the 27th March. The police say they are pressing for a restraining order for me.

I have suffered from manic depression since I was a child and got prescribed anti depressants from the doctor but applying to go on the local housing register with Kent Home Choice resulted in my application being denied even with medical evidence from my GP.

I looked at private renting another place but as I am signed off by my GP and my girlfriend only works part time we have been unable to find anywhere even with the cash to move in. They want to see we work full time and NO DSS.

My landlord has done nothing to kick her out and when I told him she assaulted me he shouted at me and threatened to kick me out over it????

I reported him to Medway Council now for not evicting her and they are looking into it but I won't hear back from that for 2 weeks.

My girlfriends parents also want her to move out now so we have a letter from them saying so which I have added to my housing application but that could take months before they get back to me.

I have a solicitor help with this too and they suggested I submit a change of circumstances to Home Choice which I did but they conveniently lost it claiming it never got submitted but I know it did.

I am at the end of my tether and don't know what to do no wonder so many 30-40 year old men in the UK kill themselves. No where will help I have been to my MP who wrote Medway Council a letter and their reply was basically I have no chance and also been to CAB who put me in touch with a charity who put me in touch with Shelter who suggested I call a solicitor which I have done but no one actually wants to help. I just get fobbed off to someone else or told their is nothing they can do. I am literally at the end of my tether. I have not eaten for days or even left my room as I don't know what will happen if I see her again.

Any advice would be very greatly appreciated.

Thankyou everyone who got this far.

Philip. :(

    Hi everyone,

I don't usually post here but I wanted to tell everyone about my current situation and see if the community here would be able to help at all as I am getting no where. - let's see :)

I have lived in shared accommodation for 3 years at the same address and since living here I have had nothing but problems with an abusive alcoholic lady who lives upstairs. - shared as in you each rent a room? Not just me several other people have moved out because of her too. In January she assaulted both me and my partner punching my girlfriend and putting her hands round my throat for which she spent the night in the police station. - well technically not, she was arrested, but presumably thereafter either cautioned, bailed and/or charged, or released under investigation A couple of days later she ran at me and grabbed me by my face when my girlfriend wasn't here as she doesn't live with me. She got arrested again and went to court the next day to enter a plea. She admitted everything so I didn't need to attend court. She was then told to attend court on the 26th february for sentencing but turned up late so they moved the court date till the 27th March. The police say they are pressing for a restraining order for me. - that probably wont happen, and in anycase just to be technical it's the CPS doing that not the police

I have suffered from manic depression since I was a child and got prescribed anti depressants from the doctor but applying to go on the local housing register with Kent Home Choice resulted in my application being denied even with medical evidence from my GP. - anyone can join the list, but you have no special reason for immediate housing

I looked at private renting another place but as I am signed off by my GP and my girlfriend only works part time we have been unable to find anywhere even with the cash to move in. They want to see we work full time and NO DSS. - You could move to another shared residence I'm sure

My landlord has done nothing to kick her out and when I told him she assaulted me he shouted at me and threatened to kick me out over it???? - well, unless the LL lives there, he cannot kick you out. Neither is he obliged to evict her

I reported him to Medway Council now for not evicting her and they are looking into it but I won't hear back from that for 2 weeks. - why, he's not obliged to. It's nothing to do with the council anyway

My girlfriends parents also want her to move out now so we have a letter from them saying so which I have added to my housing application but that could take months before they get back to me. - Again, shared residence seems to be the answer

I have a solicitor help with this too and they suggested I submit a change of circumstances to Home Choice which I did but they conveniently lost it claiming it never got submitted but I know it did. - how are you affording a solicitor without a job?

I am at the end of my tether and don't know what to do no wonder so many 30-40 year old men in the UK kill themselves. - Yes male suicide is disproportionately higher in that age range than other categories. I'm not sure how that is relevant to anything other than you mental health though No where will help I have been to my MP who wrote Medway Council a letter and their reply was basically I have no chance and also been to CAB who put me in touch with a charity who put me in touch with Shelter who suggested I call a solicitor which I have done but no one actually wants to help. - have you tried helping yourself? I just get fobbed off to someone else or told their is nothing they can do. I am literally at the end of my tether. I have not eaten for days or even left my room as I don't know what will happen if I see her again. - the short answer is you need to move. So concentrate on that.

Any advice would be very greatly appreciated.

Thankyou everyone who got this far.

Ok, stay where you are then - because that seems sensible.

Yes I see what your saying but no where will take people on benefits. Everywhere is "NO DSS" or for a place at £500pm rent they want £1500 or more to move in. Even with alot of house shares they want a grand to move in. I could never afford that.

No, people on benefits rent all the time, so landlord will take them.

Not sure what the upfront costs are, that you refer to. But between the two of you I'm sure you could save up. I don't see an alternative, so it's largely a moot point. Either move or don't.

I am sure you mean bipolar not manic depression. It hasn't been called that for years. Do up have a social worker? Does your community mental health team not help with housing? What is your GP doing about referring you to the mental health team in your council?

I don't think you are going to get social housing through a letter from your GP you need to be using the council's mental health facilities.

What area do you live in?
I have just gone on that spare room website and there is an option for "housing benefit considered" when I select that, there are still options coming up in Manchester.

When I was diagnosed it was called manic depression thats why I called it that. I was in care when I was 13-14 but even then social services left me for dead never mind now. CMHT are a joke in Medway. All my GP does is give me pills they don't want to refer you anywhere and I don't even think Medway has any mental health facilities although I am on the phone to them now.

I just had the police turn up at the door as the woman upstairs just assaulted her own daughter. That is how bad she is.

But it's irrelevant to your housing situation.

You and your gf needs to sit down and work out what you are going to do.
