Airport Pub Fine

Hi all,
I apologise if this has been covered elsewhere but wasnt sure what advice to take
My wife used my car to take her mother to Manchester Airport Terminal 3 but decided to stop off at the Airport Pub to view the planes. She paid for parking. Then decided to walk to T3 with the mother in law and on her return she was 14 minutes late according to the images on the letter I have received.
Upon arriving at the Airport Pub the ANPR in operation doesnt take into account the amount of time it takes to park and pay. This took a while.
The private company who sent the letter and operate the parking facility are Smart Parking. They are requesting £60 payment in 28 days or fail to pay the fine it is £100 or be taken to court.
The event occured on the 10/02/19. The date on the letter is 07/03/2019. This is over the 14 days. It is 25 days difference.
The letter has my name on it, and address but it was my wife who was drive. I have read somewhere about POFA on a different thread. Can the ticket fine be cancelled as its been over 14 days?
Is there any advice you can give me?

I'm sure someone will be along to inform whether the land would be considered relevant land (might be worth having a search of Airport Pub, or T3). The reason I say that is that if it is relevant land under POFA, there is 6 years to bring a claim, but if it is covered by by-laws, then it reduces dramatically to 6 months.
Anyway, probably best to start off at the NEWBIES post #1, and have a good read through that. THE PUB IS PROBABLY PRIVATE LAND, IN WHICH CASE POFA2012 APPLIES AND THEY ISSUED IT TOO LATE FOR KEEPER LIABILITY
so appeal as KEEPER using the blue text template from the NEWBIES FAQ sticky thread , post #1, no blabbing about who was driving
ensure you choose KEEPER if appealing online, do not default to driver
as KEEPER, you are ok, so no naming the driver , to anyone
any popla appeal will major on POFA 2012 and keeper not liable0 -
Did you eat/drink at the pub? If so complain to the pub, ask them to get this cancelled.
Did you read the signs? What did they say? Did you note that you needed to comply with what they said?
No more can anyone park on a private car park and not read the signs, or worse, ignore what they say. If everyone complied with what the signs say, the parking companies would die.
But of course the British motorist knows his rights and parks as he wants/decides.

thanks for the advice, I have gone on smartparking.com to appeal but I am not given the option to appeal as the KEEPER.
I can only complete a form followed by my appeal statement.
Should I just complete it and then paste the statement template?

Read what an MP said recently in the House of Commons about this scammer.
Pete Wishart (SNP, Perth):
"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices."
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. It received The Queen's Assent today.You never know how far you can go until you go too far.0 -
Hi i have recieved a PCN today from smart parking from the airport pub on 30th june.
Unsure what to do as i paid for 2 hours then 1 extra hour ( i do not have my tickets) and looking at the timings but the camera gets my car in at 11.37 and leaving at 14.52 which is 15 mins 'extra' however we had to wait for a parking space and time spent queuing for tickets.
Unsure what to do next any help is mmuch appricate.0
