Paying for home care while in hospital

My elderly nan's health started to deteriorate last year and following an assessment the council arranged a care package comprising 4 home care visits a day. Nan paid a contribution towards this as she has some savings.
Unfortunately despite the carers she had several spells of illness which necessitated three separate stays in hospital. The final stay lasted several weeks and it was decided that it would not be safe for her to return home so she is now living in a care home.
We have now received a bill for the costs of her home care but it includes the weeks that she was in hospital. We challenged this but have been told that she still has to pay for the care for these weeks even though she didn't receive it and we informed the agency that she was in hospital so they didn't send the carers out. Is this correct and if not how do we challenge it?

You need to look at the contract that you/your mother signed and see what it says about cancellation. Also bring social services (if they organised this care) in.
I had a care agency charge a lot more per hour for care than they should have done. Got hold of the social worker and she sorted it out.
This was after three sets of invoices had already been issued lol. In my opinion these agencies try to get anything they can out of you.
I hope you informed them of your mother being in hospital in writing.0 -
I know with my support hours and the company I use they rota the hours on one month in advance. Means that if I get sectioned the company still get payment for hours while I'm in hospital. If I go away on holiday I arrange with my manager to have my hours before I go or they'll will still rota staff on with me while away.0
