Carpet defect - consumer rights

Hi,
I’m wondering if anyone can advise me. We have had a carpet for three years which covers the stairs, landing, and four bedrooms. It is the same carpet throughout. In the last year the stair carpet has become excessively worn. We approached the carpet company about this and they agreed to replace the landing and stairs under the guarantee. When the measurer came out to measure up he remarked that it could be due to a manufacturing defect and advised the whole lot may need replacing. A subsequent independent inspection discounted this.

Although we are fine with this the replacement carpet is going to be a different colour as the original colour is no longer available , and may be different enough from the bedroom carpets to stand out. The look we wanted was the same carpet throughout and now it’s possible this will be lost due to the partial replacement. The carpet company said that even if the same colour was available the tint would be different.

So, our main concern is that the carpet colours will now be different and as this was not what we wanted or paid for three years ago do we have any case to ask for a full replacement on this basis??

Many thanks for any advice
Nick

As the independent inspection confirmed there is nothing inherently wrong with the carpets, no, I don’t think you have any rights for full replacement of all the rooms’ carpets. A stairway and landing carpet is always going to wear faster than those in the bedrooms because it will have so much more traffic.

Have you considered going for an entirely different colour for the replacement? Going for a close match is going to make the difference obvious whereas an entirely different colour won’t look like you’ve tried and failed to match them.
  • Hi, thank you Aylesbury Duck. The carpet is so heavily worn on the stairs after just three years. Makes me wonder if I should have another inspection done. I dont think I've ever seen a carpet wear this fast!
