Lease vehicle - NTK not received.

A windscreen PCN was issued to my daughter in laws car last november. The car is a lease vehicle and is insured for more than one driver. Following the advice on this forum (many thanks to all those who put so much effort in) I told her to wait for the NTK.

No NTK had been received but today a debt recovery letter was delivered. It states that details were sent to the address provided by the DVLA, this of course would have been the lease company, but, as there was no response they have used a tracing service to issue their demand for payment to this new address.

The PCN was issued at a time just before my daughter in law was moving home and approximately one month before the car was returned to the lease company.

Assuming the NTK was sent to the lease company, if there was any further correspondence it failed to reach my daughter in law.

My question is, should she request the NTK be sent to her current address with a view to go through the appeal process or just proceed with ignoring this debt collector stage?

Thanks in advance for advice offered.

Why not tell us who the PPC is because that could influence the advice we give you.

send an SAR as HIRER by email to the DPO at PARK DIRECT and get copies of all paperwork etc, including any NTK or NTH

seems strange that they have managed to trace the hirers address even though it appears that no NTH was sent to the hirer

she can only get her own data, so bear that in mind, and no blabbing about who was driving either, the request is as HIRER, she would never get an NTK because she would get an NTH , so I bet they have failed to follow POFA

its far too late to appeal, so get that idea out of your head, and IPC member appeals are usually futile anyway, which you would already know if you had read the NEWBIES FAQ sticky thread

    Thank you Redx.

I have drafted an SAR, I would be grateful for your opinion on whether this is sufficient or not.

    RE: PCN XXXXXXX

I have recently been contacted by DRPLtd demanding payment for an outstanding PCN on your behalf.

I was the hirer of the vehicle in question but I have received no previous correspondence from your company. I now require you to provide details of the personal data relating to myself that you hold and copies of any documents intended for my attention in relation to this matter.

I expect this request to be complied with within 28 days. Should I not hear from you by this time I will consider the matter closed.

You might consider the matter closed, but they won't! It's not what a SAR is about.

    Why not use this:

Thanks for the link. How does this look?

    Dear Sir/Madam

    Current Address: xxxxxxxxx
    Previous address: xxxxxxxxx

Please supply the data about me that I am entitled to under data protection law relating to myself.

Please also provide copies of any documents relating to PCN XXXX for which I am now receiving demands for payment.

If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.
    Yours faithfully

you need it to be from the hirer , so

relating to myself as hirer of vehicle AB123CDE

ADD SOME FORM OF I.D. THAT SHE IS COMFORTABLE WITH, BECAUSE SHE WONT HAVE THE V5C TO FALL BACK ON

so dont ping pong it, email the SAR with I.D. , like a utility bill or hire doc or similar, you can see what to ask for in the NEWBIES thread , post #2 , plus add in the one month DPA warning, so maybe include this

Thanks for all the advice. I'll not bore you with posting my new draft as I think I have enough to go it alone now, and it contains all your suggestions anyway.

Thanks again, I'll be back if anything interesting transpires.
