If it was taken out a few months after your mortgage as you suggest then no one will entertain the argument that it was part of the mortgage as you had already received the funds - unless you have a better complaint reason then this will have no legs I’m afraid.0

They have written back to me telling me that they never pressured customers into taking out policies.
Therefore, expect nothing from an Ombudsman referral and you won't be disappointed.

I believe my valid reasons for the PPI complaint would be I felt this was part of the mortgage application process and not compulsory.
The problem with that allegation is that it is almost certainly unprovable. Plus, you apparently bought it at a later date.hey have written back to me telling me that they never pressured customers into taking out policies.
People who were pressured generally complain within weeks or months. Each year that goes by, that allegation gets weaker and weaker. You have no evidence to support your allegation and 13 or so years after the event, it is a weak complaint reason you would not expect to succeed on.
This is why they were easily able to refute that point. Plus,by switching from didn't know you had it to saying you were pressured, you have contradicted yourself.I am an Independent Financial Adviser (IFA). My complaint about my life insurance was I didn't realise it included a PPI element (taken 2006). My complaint about my unemployment cover (taken 2008) was I thought it was part of the application process, albeit this was signed 2 months later, I have the original letters from CBS (one each month) post my mortgage application asking me to sign the documents as they say they will give me 3 months free because they think it's really important for me to protect my mortgage. This is the reason I'm saying I felt it was all part of the mortgage application and pressured into signing them.0

A distance sale (postal sale) cannot be considered pressured, nor can you say that you felt it was a requirement of the mortgage two/three months after already having the mortgage - the free period at the beginning will also be another thing that goes against the complaint.0

Thanks for your comments. Are you saying because they kept sending me the form to sign as it was obviously missed during the application now counts as a post sale? Wouldn't the free period count as them persuading me to sign as they were offering a free period? Also, in the letter it states that they highly recommend it which is why they offered the first 3 months free.0

None of what you say amounts to pressure... they may well have made offers or recommended it (all these things are to be expected), however you had all the time you wanted to consider before choosing to accept - pressured sales would be face to face where someone keeps pushing you to sign when you have limited time to consider your options I.e. a half hour appointment.0

They key will be the wording of the letter sent after 3 months. If it invited you to continue and therefore clearly optional then they can easily reject it. Allegations of pressure wont wash with postal cases unless the letter uses words that tell you that you have to have it.I am an Independent Financial Adviser (IFA).
