End of IVA

I have been in an IVA for nearly 4 years and as i approach what they are calling the final year they are now asking me to produce my complete bank accounts (statements) for the last 3 months. My undertanding is my bank account is my private info. I have no problems providing my last 3 month payslips but do object to them having my bank statements. Are they allowed to demand this info or can i refuse.

    Hi,

Providing 3 months worth of bank statements is a fairly standard request from your IP.

Normally you have to do this at the begining of your IVA, and again at your yearly review, so if your in year 4, you should have provided them 3 times already ?

I can`t see your issue to be honest, if you don`t` cooperate with your IP they can fail the arrangement, depends which is more important to you, your arrangement failing, or your IP finding out you watch netflix.

  • You are required to provide evidence of your income and expenditures to your IP. A request for 3 months worth of bank statements is normal and should be provided at each annual review, so I am surprised that these have not been requested yet.

Why do you not want to provide the bank statements? Is there some information in them which you wish to hide from your IP?

I was given a choice to either provide bank statements or proof of all the bills in my expenditure in the way individual statements etc. Maybe you could ask if that’s ok instead? I had nothing to hide, I just didn’t feel comfortable with a stranger going through them at the time.

Lots of people who sign up to an IVA have little real knowledge about what they are actually doing, yes the information is provided to them, mostly, but lets face it, who actually reads the small print ?

Under the terms of an IVA, you are, for all intents and purposes, insolvent, which, whilst not taking away your statutory rights, still means you are at the IP`s beck and call until the arrangement ends, and anything they reasonabley request, must be provided.

if you have nothing to hide, whats the issue?

you can always black out the account number and sort code, if its your personal data you are concerned about ( my IP allowed me to do this )
