ParkingEye charge for sold car.

Hi all

My daughter sold her car & a week later got a ParkingEye charge notice for overstaying in a supermarket car park.

The date of the incident was the day after the car was sold.

She contacted ParkingEye through their website saying the car had been sold the day before and she wasn't the owner / driver / keeper on the day of the parking charge.

At that point she hadn't received the confirmation letter back from the DVLA saying that she wasn't the keeper anymore. (it arrived a day or 2 after contacting ParkingEye).

She now has an email from ParkingEye telling her she has to submit evidence (either the confirmation from the DVLA or providing the name / address of the buyer).

They also say that the charge is on hold for 14 days to allow for proof to be sent.

I'm not usually an advocate of stroppyness when dealing with companies just trying to do their job but I do feel as if she is being asked to do their job for them.

Surely it is up to them to get the updated details of the cars new keeper from the DVLA themselves.

Shall I advise her to tell them to do that (or do one!!) or am I (as often advised) just being a grumpy old man & should she give them what they want?

We live in Scotland if that makes a difference.

    Yes, you could keep your grumpy old man hat on but all that would achieve is PE continuing to hound your daughter. You might want to ask your daughter what she thinks about that. ;)

    Doesn't the PE Notice to Keeper advise how your daughter should notify PE about change of ownership?

    Email ParkingEye back with the evidence of the new keeper's name & postal address, but warn the buyer to come here & learn about the scam, not do something silly like pay it.

    We can't have some victim paying it, or the new owner doing something equally daft, like sending a weak 'appeal' telling P/Eye who was driving, especially not in Scotland.

    The new owner can easily get it cancelled I expect, by complaining to the retail park.

    I am sure that she has to do no such thing, although the sensible thing would be to do as CM says above.

    However, they are doubting her word, and if she wanted to be really awkward, she could ignore everything and let it proceed to court, where she could counterclaim for harassment and possibly a DPA Breach.

    I know which one I would do.

    That would not make any difference. The details the DVLA had would still show the OP's daughter as being the keeper.
