Difficult to know how they would respond to the driver unless you gave an "address for service" unless it was all done by e-mail and you supplied the e-mail address of the driver.0

When my mother returned from holiday she filled in the transfer of liability section on the original NTK paperwork and posted it back to them.
As i don't have proof of postage of the Transfer Of Liability do I have to send it again ?
So MUM repeats the name & address in reply and tells them to cease & desist.
Then the driver might get a LBC & claim but at least she's out of the loop.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, Thanks both for the replies.
Yes they must have either lost or never received the Transfer letter.
I will get her to send an email today naming me and give them the address for service etc.
Will it not start again from scratch then with a chance of POPLA, ?0 -
No, because you already appealed, so you had that opportunity already:They also stated to POPLA "We received an appeal on 29/10/2018 from the keeper and driver of the vehicle" No they did not as she was in Cyprus at the time, Driver was ticked on their appeal online portal as I was appealing as the driver and explained in clear terms who was driving.
Your Mum's transfer of liability will get you a LBC and then you can defend and win.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I only ticked driver on Brittania's appeal section on their website. I'm sure everything to do with POPLA was as Mom (keeper of the vehicle).
I will send over the details to them and see what happens and post any further feedback here.
Thanks again all for your great support.0 -
Yes but by appealing it shows you were already served with a PCN.

Cheers.
Ok I understand now.
I have informed them of the drivers details and address for service etc. Asked for confirmation they have received it and then to cease and desist all forms of communication.
I have got my SAR letter (Legal Beagle template) and a letter asking BW Legal for a "restriction of data processing and the case should be put 'on hold' which I got from the sticky thread ready to send when / if I get a genuine LBC etc.
In the meantime I was going to write to the Landowner. I have got the details from Land Registry.
This is always a VERY good idea to complain to the Landowner or retailer, and LBC stage is your chance. When faced with a polite but ''angry customer who will never return'' complaint (no template, write it from the heart!) many retailers cancel these at commercial car park sites.
I see it says no template but is there anything that I should definitely include ?
Things like ANPR not being fit for purpose or Sir Greg Knights bill etc. Or just a simple letter stating what happened and a copy of my Pay and display ticket.
I will post it on here before sending if you guys think it's important.
Cheers again.0 -
