Parking Eye CCJ within 28 days

Sorry about starting a new thread, but I have tried to read as much as I can and I am struggling with how much information there is about this subject & the judgement for the claimant (in default) letter is from 26th Feb.
I received bad advice and ignored many parking eye letters and then did not receive the letter from Northampton Court Business Centre.
Should I pay for the set-aside and how best to defend afterwards plus any other advice is gratefully received.
The reason for the original ticket was I had no change, I paid with my credit card at the pub who's land it is so I can prove I was a paying customer that day.

I should say I am a bit of a panic about this and I think my options are to get a set aside then defend my self properly, pay or live with the CCJ and worry about a debt collector calling and bad credit rating.

You'll struggle to get the case set-aside if the paperwork was sent to your correct address. Are you sure you didn't receive anything from the court? I believe they also send a reminder so it'll be difficult to argue that two letters from them went missing.

I have never heard of a court sending a reminder if a claim goes unanswered.

Are you sure about that, garth549?

My post goes to a communal area & the letterboxes are unlocked.
I was all set to go for the set-aside option but don't want to throw good money after bad - plus I am pretty stressed about the whole thing.
Seems so unfair to have evidence you were a paying customer at a pub and end up with a £200 fine or a CCJ.

the judgement for the claimant (in default) letter is from 26th Feb.
You are in time to pay it and remove the CCJ completely (as long as you do so quickly).

Or, if you take longer over this, set it aside costing £255 (unless you qualify on income ground for no fees/help with court fees?). You should show evidence that the mailbox is shared and be prepared to state on oath of the Judge wants you to, that you DID NOT receive the claim.

If I pay the £200 to remove the CCJ, can I then do anything to get the money back?
It seems so unfair, I have evidence I was a patron of the pub where the fine is from.
Or should I just pay the money and write if off as not worth the stress and put it down to experience?

Sue the pub, would be your only option then.

I'm really confused - so many good stories on here about standing up to parking eye and other parking companies.
It sounds like my only option is to pay or live with a CCJ

You would not advise asking for a set aside as I did not receive a letter from the court and try and defend?

I am trying to pay the CCJ but I am finding it hard to contact parking eye to pay it, the court letter just says to pay the claimant and has their address. I don't have a cheque book so can't post this to them.

Pop into the local branch of your bank. They will be able to supply a cheque.

If you were successful in getting a set aside it would cost you £255 to save £200. Recovery of your set aside fee can only come from the Claimant (PE) and you will need to prove that they have done something wrong in applying for a judgment in default. I can't see they have.

Lose your set aside and you're then looking down the barrel of having to shell out a total of £455. You're not going to get this all done by the court's 1 month deadline to pay the original £200, and I don't think anything is put on hold while you go through the process (but happy to be corrected), so your credit rating will be trashed (probably irrecoverably) for 6 years, you will have lost your set aside fee and you will still owe PE £200.

I'd get that cheque off to PE sharpish!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
