    Everything has all been filed on time, I just left it late-ish to ask about being a lay representative for the Mrs as I have been handling the case so far.

    What I feel is naughty on the claimants park is that the images supplied with the original PCN and the generic reason of 'breach of terms' or whatever they said encourages you to fight the ticket rather than settle early.

    If we had parked in someones spot and they had taken a photo with the car visibly in a numbered bay and another of the front of the car with the number plate and without a residents permit in the window, combined with a reason 'parked in a residents bay without a residents permit' - you would pay up.

    That wasnt the case, and they post two generic photos of a vehicle without a registration or even of the car in a bay with a generic reason - who would pay that?

    They had their side heard from the papers submitted whilst I acted as a litigation friend for my Mrs (the keeper).

    The Judge ruled that the notice was sent and more importantly received outside of the relevant period
    The notice itself didnt satisfy all of paragraph 9 sub parapgraph 2
    The signage wasn't lit (important when enforcing parking at night) and the height and size of the text on the sign meant a contract couldnt be formed
    Finally, there was no evidence that the vehicle was parked in the wrong bay

    My question is this: I have seen that others have been awarded damages, is this something I can apply for after the fact or is this something I should have raised at some point during the whole process - if so, when?

    Did you submit a costs schedule with your witness statement and evidence? If so, the time to raise it was just after the judge said "case dismissed." You might be able to send a letter/e-mail to the relevant court and ask for it to be put in front of the judge.

    First time doing this and so I wasnt aware of a cost schedule was. I will have a look and see what can be done.

    It's the first time for (nearly) everyone who posts on here but all the info was/is in the NEWBIE sticky and you will find examples of cost schedules in the NEWBIE sticky post # 2. You might not get anything out of it but then again you might and if you don't try you definitely won't. Good luck with it and let's hope the judge accedes to your request.
