Builder refused to fix item reported on 5-7 month purchaser list

Looking for a bit of an advise really.

We bought a new house from Bloor Homes in August last year. Last month we submitted 5-7 month purchaser list to their regional customer service with the issues we want them to fix.
One of the item on the list was rough plaster around the wall near patio door to which they said we would not cover this item as this was not reported in the first 10 day list of moving to the house.

I have explained house is still under 2 year builder warranty and the issue was noticed quite some time back but we were waiting to be reported on 5-7 month purchaser list. Their customer service is quite adamant and does not want to send workman to fix it.

Just wanted to find out my rights and what (if any) action I can take against them.

    Consumer rights do not apply to house purchases, so you are bound by the terms and conditions of the builder's warranty and the NHBC 10 yr guarantee.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    So basically what you are saying is I have no option as I have agreed to their T&C. This two year builder warranty is a bit of a gimmick then.

  • Thanks, one of the response to my query said there are no consumer rights on house buying.

    Houses are not covered by the Consumer Rights Act 2015, which is the principal legislation in consumer rights' issues. Someone once said on these boards "you get more consumer rights buying a £10 kettle than a £1,000,000 house".

    If the builders won't play ball see if you can cajole them into doing something when they come to fix the other issues. It may cost you a few pounds, but it would be worth it.

    The warranty isn't a gimmick, you just did not comply with its T & Cs

    I wouldn't trust Bloor Homes to sell me the £10 kettle, let alone a home of any value.

    You need to read the terms of the warranty, to see what it says about reporting defects - and whether a 10 day limit is specified.

    (I'd be surprised if it says you have to report them within 10 days - but the only way to find out for sure is to read it.)
