Upstairs Neighbour (who's also friends with landlord) Parking In My Space

Hi,

I live in a flat with 2 parking spots (1 for me and 1 for the tenant upstairs

Shared garden

Problem is the older tenant upstairs has recently got a van he is selling for his son.. so I asked him about the van as I didn't know it was his/his sons he is selling for him doing it up (would've been nice to ask).. he never apologised or said anything like it will be gone in xyz days or weeks.. he was friendly enough but I guess he just assumed I'd be OK with it because I don't drive.. but that's not the point surely!?

I have a disability, I don't drive, but need the parking space for when guests or family come to take me out.

How do I approach this situation? I'm thinking contacting the letting agent by e-mail? since the landlord owns both properties and I was specifically told when I moved in that I had my own parking space.. weather I own a car or not is irrelevant.. I have a disability and need it free.

I have bad social anxiety so don't like confrontation.. so want to avoid the awkwardness of approaching the neighbour myself.

What are my options? contact the agency? send a letter to neighbour upstairs? contact the police? buy a car and park in there?

Because the landlord is friends with the tenant above and I've seen him visit him.. it does create a possible conflict of interests if he has to deal with disputes, surely?!

  • Buying a car and insuring and taxing it seem a bit extreme to solve this problem, how often do people call to take you out and is there somewhere nearby they could park? The police will not be interested, so the remaining option is to contact the letting agent but they might not want to get involved.

    Take a picture of the van and send it to the letting agent notifying them that your space is being used and as you are disabled this is affecting your visitors who have to find other means of parking.
    Also let them know that as part of your rental agreement, one of the parking spaces comes with your tenancy.

    As above but also, how valuable is the parking space to you really? You could try to negotiate a reduced rent for the loss of amenity until the space stops being used by your neighbour ...

    Very often car parking spaces are allocated for the tenants only and not for family or visitors. Maybe worth checking if this applies to your tenancy.

    Is this vehicle SORN contact DVLA with the reg number the owner could get a fine if its not taxed or insured and parked there just for it to be out of site, say round the back of the property, the DVLA will probably know when, tax, MOT & insurance ran out.

    So... you have been able to chat to your neighbour about the van . Why not ask him if he can move it when your visitors are coming to collect you?
    If you really can't talk to him about it, then how about a nicely worded note, explain "although I don't need the space all the time, I do need my friend's car parked close by when they come to take me out."
    Ask him if you can let him know the day your friend is visiting, so he can park the van in his own space on those days.
    End the note by wishing him well, and hoping that they are able to get the price they want for the van.

    If they are getting it ready to sell then it isn't going to be a problem forever after all.
    I think that would be better to try that,than getting all official about it right from the start. You don't know when you might need some help/co-operation from your neighbour in the future, always better to try being nice first.

    p.s. It sounds like this chap might not have realised that your space was ever used, so didn't think it would cause you a problem :)
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)
