Section 75 for a badly installed floor?

Hi looking for some advice.
Back in December we had a luxury vinyl floor fitted through out the whole of our bungalow. Its been fitted very badly big gaps around most of the edges or bending up the skirting as well as coming unstuck. Not what i was expecting for £9k

I have been back to the supplier/ fitter who came out to have a look, they agreed that it wasn't great came back for one day fixed a couple of the easy bits, but here we are 3 months later still trying to get it resolved. I paid on my credit card am i covered under section 75?
If so how do i go about claiming?

    I hope that the £9k included the fitting cost and this was not one of those 'buy the flooring from us and pay the fitter directly' arrangements.

    On the assumption that it is not, in the first instance speak to your card provider. Bear in mind that, at some point, they are likely to need an independent report on the fitting detailing the issues.

    Have you already attempted to claim whatever it is you want from the supplier/fitter? What was their response?

  • So far they have offered one date to come and sort the problem and we are not available, we offered them 6 dates that we could do this month and they have said that they can't do any of them....

    Did you pay £9,000 for the vinyl and then paid extra for the fitter to fit the flooring or did you pay £9,000 from a firm to supply and fit as the latter i think you will have cover for but if you paid a fitter to just fit the flooring then you will not have Section 75 cover unless you paid him/her using your credit card.


    You will have to tell us who and how you paid for all the flooring and fitting to get a better answer.
  • I paid £6.5k to the floor and £2.5k to the fitter separately.
    The fitter was organised by the flooring company.

    Was the fitter an employee of the supplier or was the fitter completely separate and you just paid them as a completely separate person

    If the fitter is a completely separate person acting on their own and nothing to do with a supplier other than via a recommendation then you have no claim against the supplier because the supplier has just provided the goods and you have got them

    you would have a s75 claim against the fitter of course but only if you pay the fitter by credit card
  • I think its probably correct that its very unlikely the OP would have any claim against the supplier and if they didn't pay the fitter by credit card then its going to be the same (no S75 against fitter either) BUT there's always small claims court against fitter potentially using supplier AND independent inspection as witness statements supporting their claim.
