Hi Umkomaas,
Yes you're right it certainly looks like the lay-by is council maintained
and a public road.
There is a Pizza Express restaurant at the exit (right end) of the lay-by,
so I phoned there and asked for the manager.
Unfortunately the manager wasn't available today but an employee of the
restaurant was quite helpful with my enquiries. Apparently, the council
owns and is responsible for the grassed area between the lay-by and
Woodford Road but not the lay-by itself. The lay-by is owned by the
landlord of the building containing all the shops and apartmernts above.
He said that employees of Pizza Express cannot park in the lay-by unless
they pay for parking charges.
I can verify this information with Stockport Metropolitan council. It may
take some time before I receive a reply though.0 -
The P&D machine stands right at the start next to the HSBC, and would be invisible if hidden by a parking vehicle. No machines further along...so anyone visiting Pizza Express would have no idea there are restrictions as there is no machine in view and NO signs at all, on that side of the road alongside the bays, unless it's changed.
All the CEL signs showing when you do a virtual walk into that lay by on GSV, are ON THE COUNCIL GRASS BANK, not on the lay by side where the bays are.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There was no entrance sign to the lay-by. The driver entered the lay-by by making a left turn from the main road. As the driver looked ahead to avoid parked and possible moving cars in the lay-by, the driver wouldn’t have been looking towards the HSBC bank building. Furthermore, as the parking machine is in such an awkward position at the extreme left side of the bank building, the driver would have difficulty seeing it from the driving seat (being on the right). In order to take notice of the parking machine it would have been necessary for any driver to turn their head and look though the passenger seat window, but why would anyone do this when entering a lay-by ?0

Yes, these sort of infringements on council land by private
parking companies shouldn't be tolerated.
The other question is - If the lay-by is classed as private
land then why do double yellow lines exist there in
certain areas ?0 -
they can paint any lines they like on the floor, and yellow lines are used because motorists are used to them and so are expected to follow the same rules as on the public highway (if it looks like a duck , and quacks like a duck ........)0

Because you said the grass verge part belongs to the council, then they have marked the kerb next to their land. The divide might be along the centre of the road - who knows? Ask the Council.
But a private firm can't put signs up on Council land, it's misleading for a start and I doubt the Council will be happy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
At last I've received the relevant information from Stockport Metropolitan Council.
When I initially contacted them they wouldn't give me any answers. In the end I
resorted to the "Freedom of Information Act" to force the information out. Despite
taking all this time the council have replied with scant details to my numerous
in depth questions.
Anyway, the details they replied with are :
"According to the Land Terrier this location is not Council owned land, it’s private
land, so the Council has no involvement in this issue."
"The cameras are positioned on private land and overlook a private layby.The
Council does not have a contract with Civil Enforcement Ltd for the issue of
Parking Charge Notices and any such notice would not be issued on behalf of
the Council."
On a recent visit to the lay-by I couldn't see the parking signs which can be
seen on the grass area (council land) in Google maps. It seems that CEL have
been informed by the council of their silly mistake and removed them !0 -
