TV Faulty after 18 Months

Hi guys,

Looking for some advice. I purchase a Samsung 55” Tv from Groupon back in August 2017 for £700. The other day the tv cut out whilst we were watching it and now it won’t turn on. I’ve tried contacting Samsung but they don’t want to know as it’s 6 months out of warranty. Groupon have offered me a £50 Groupon voucher for the issue.

I’ve been looking around the Consumer rights act and EU directive 1999/44/EC and just wanted to check what my rights were in this situation. I’ve seen about an independent assessment proving there was a fault with the TV

You are correct in your research that you need an independent report stating an inherent fault as over 6 months have gone past.

It’s always a bit odd with groupon, who actually sold you the TV? Groupon, or did you buy a voucher for https://www.tvshop.com or something? Anyway whoever the retailer was, if it is found to be inherently faulty, need to repair, replace, or offer a refund. Whilst this may be reduced to take int account your 18months use it is unlikely to be as low as £50. They also need to pay the cost of the report IF found inherently faulty.
  • Hi Katrina,

Thanks for your advice, do you know how I go about finding someone to carry out an independent assessment?

A local television enginneer / TV repair shop.
Thats for action against the actual vendor under CR .
They can repair , replace or refund as they wish .
Note refund 18 months usage pro rata probably £350.
  • I’ve organised an independent repair with the TV repair company Samsung suggested to us. If they find a mechanical fault would I take this up with Groupon as the retailer or Samsung as the manufacturer?
  • It’s not letting my edit my previous post. That was meant to say independent assessment rather than a repair.

It is the retailer that is responsible for complying with the Consumer rights act.
It's not simply a mechanical fault that is needed. It's an inherent mechanical fault which means that the fault was due to a manufacturing defect and the cause of the problem was there when you made the purchase even if the fault wasn't apparent at that time.
This could be something such as a poor solder joint or a substandard component.

Do not get it repaired yourself otherwise you could lose all rights to have the vendor rectify. You cannot compell them to pay your repair costs.

Faulty does not mean inherently faulty. You need a report not a repair

Not sure it would be a mechanical fault, probably an electrical fault?

And most-probably a blown capacitor on the PSU board.
