Company Car PCN Confusion

Good Afternoon Folks,

Firstly I would like to apologise in advance if this questions has already been asked. I have been browsing the site since Friday trying to put together a response for a Parking Charge Notice I received from UKPC,
My car is a company car, and I understand from the Forum to appeal online using the Standard Blue Template. However the few lines underneath the template are causing me some confusion.

THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE.
THE DRIVER IS NOT IDENTIFIED.
DO NOT PUT YOUR NAME HERE INSTEAD, IF YOU ARE NOT THE KEEPER/HIRER/LESSEE. YOU ARE NOT HELPING IF YOU DO THIS WRONG BY APPEALING IN THE WRONG NAME!


Specifically the part 'Do not put your name here if you are not the keeper/hirer/leesee.'

My Company Leases the Car from a 3rd Party, and it is registered to me as a Personal Company Car. Does this make me the Keeper as far as this appeal is concerned? If so I assume it is safe to sign the appeal off with my Name and Address as the keeper without causing issues?

For Example:

Yours Faithfully, <My Name and Address>

    Sounds like you are the keeper for day to day purposes, or possibly the Registered Keeper according to your company's system.

    Either way, the important thing is not to identify the driver, so yes, I think you're safe to appeal with your name & address.

    I'm confident that the more experienced members will soon correct this if I'm wrong.
  • Thanks for the quick response. I have also reached out to the manager of the Gym to see if they will cancel the charge, I will wait a couple of days before sending an appeal in case they manage to cancel it.

    I don't think you should use the blue template. You might find one of the Edna Basher appeal templates for hire or lease or fleet cars fits better.
    You appeal as lessee or hirer or day to day keeper, whichever fits your case best.

    See what the more experienced regulars say first.

    Always complain to the landowner.

    Please also complain to your MP about this unregulated scam.

    UKPC were previously caught doctoring time stamps on their photo' "evidence" so you should mention this in your complaints.

    Is that to say that the vehicle is registered with the DVLA in your name and at your home address?

    If so, you will be its registered keeper. Ultimate ownership by a lease company will not be relevant because they're effectively already out of the loop.
  • Thanks for your replies. The car is registered to my company, what I meant to say is that it is a company car that allows personal usage. So I pay tax on it. I did see the template Edna created, however I understood that was more for the lease company themselves to send, rather than me intervening myself.
    I have had a semi-positive response from the Gym, whereby the GM has informed me that he has sent a cancellation request and is awaiting a response. I would still like to be prepared in case that doesn't happen.

    Whoever is the RK, you should complain to your MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. It has cleared Parliament and hopefully, this will become law shortly.
    You never know how far you can go until you go too far.
  • I will certainly be making a complaint, but would rather get the immediate problem out the way first, and then complain about how much time it has cost me, and in turn, him / her.
    I am still awaiting information from the Gym Manager regarding the cancellation. Unfortunately I have seen on a facebook community group another visitor has a PCN from the same gym, and apparently the Gym Manager told said person it would be cancelled 3 weeks ago and they are still being chased for it. I have a horrible feeling that the Gym Manager may just be telling me what I want to hear, which is a shame as he seems Genuine enough. The bright side is I have an Apology Email from the Gym Manager saying he has requested a cancellation, which may assist my appeal should I need to?

    If you have a windscreen PCN, use the blue template unedited.

    Not a specialised 'lessee/hirer' one. That's for replying to a postal PCN to hirer.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
