The case never really got going, first thing the judge picked up on was the fact the Claimant had no evidence of who the actual land owner was so judge dismissed the claim. Didn't get in to any of the other stuff.

Ok, here we go, a summary of my morning at court.
Shakey start when I realised the car park I was going to use was permit holder only during the day so had to swiftly find somewhere else to park. Wasn’t an issue as I’d left plenty of time and still got to the court with 30 mins to spare.
Eventually found where to check in with the usher, it wasn’t obvious, and took a seat to wait.
Rather predictably the BW rep (Miss Pearce?) entered the waiting room and approached, somehow knew exactly who I was, probably tipped off by the usher, and asked if I wanted to have a chat. I politely declined.
A bit more waiting, getting pretty nervous and stressed out, eventually get called in to the court room.
Judge Britton kicks things off and explains he doesn’t have a copy of the Claimant’s witness statement. Their rep couldn't verify if or when it was sent so the judge asks if I received a copy, which I confirmed. He gives the benefit of the doubt it probably was received and had been lost by the court. But still, probably works in my favour I thought.
The rep offers the judge her copy for a quick read and to get it copied by the usher.
First thing judge picks up on and asks the rep about - who is the land owner and where’s the agreement authorising 3D parking to operate on the land? All he can see is an agreement between 3D and Hollybush Lane parking .
The rep says Excellent Question, I don’t have that info and will need to take instruction.
Before sending us out, the judge explains things a bit to me, saying the case will be dismissed if they can’t prove the land ownership and starts summarising the basis of my defence, which did sound as though he was in my favour.
So I’m back in the waiting room, nerves and stress levels definitely rising. Whilst I’m there and the bw rep goes off the judge hears another case. Eventually the rep comes back and asks to have a chat. I decline and start thinking what that means.
Interestingly there was another 3D parking case scheduled so while I’m waiting to go back in, that case gets called, by a different judge, and the bw rep goes in to that. So still more waiting! Think that case was 3D vs Cox, Judge James?
Can’t be sure of the outcome but think that went on for about 20mins.
So I get called back in to the court room (as I’m going in the usher says to someone else who’s waiting for their case - don’t worry it won’t take long. Good sign!). I’d barely sat down and the judge kicks things off again. The bw rep confirms the name of the land owner but has nothing to prove this or authorisation etc.
And that was it really, judge dismisses the case and doesn’t even touch on anything else. Bw rep put up no fight against this.
I ask about costs, judge says I can claim expenses and loss of earnings but doesn’t really let me get a word in about unreasonable behaviour. I’m not sure I had a clear enough head about this anyway.
Glad I took my payslip as bw rep wanted proof.
Although the whole thing took up the whole morning the majority was just waiting. And even then I barely had to say anything in the court room. I got the sense the bw rep did a lot of these cases and was chatting away to the usher at one point.
Glad of the experience overall, but also glad it’s all over now!
