There was an outstanding balance of £700 and I defaulted in March 2018 for this amount. In Feb. 2019 I got an automatic refund of £600 towards the outstanding balance and a good will gesture of £75.00. There has been poor communication from Barclaycard. I have since spoken to them and requested they remove the default notice, they have said they will not. When I requested my signed contract I was told they do not hold this as it was an original egg card and a long time ago. I would like to try and have the default removed from my credit file. I never agreed to have a barclaycard and have never had one.

As it should be. Even on an unenforcable debt refunds can be taken this way.

The only way it would have gone to you is generous good will. Ain't getting that from BC.

So if the refund was for 600.00 on an unenforceable outstanding balance should that amount not have been payable directly to me and not as a contribution to what was outstanding. They also gave me a £75 as a gesture of good will. The default was for £700 and this is what I am more concerned about. Surely an account must be verified before a default can be orchestrated.

It only means its unenforcable in court, it does not mean the debt does not exist, it still does, it just means you cannot be chased through the courts for it.

They can still chase you, but there level of threat will have diminished conciderably.

  • So you did owe the money. The account defaulted as payments stopped. Then the refund took £600 of the debt off.

You can either pay the remaining that's owed or leave it for them to chase you for and maybe eventually get bored

The default is more important to me than balances and I now owe nothing. I never had a Barclaycard and I never signed any terms with them.

I recognize I owed Egg money and I paid this via Barclaycard who have been acting as a collections agency on behalf of Egg.
  • If you stopped paying then the account will default.

    So the reporting is correct

Did the default originate from Egg or Barclaycard ?

If it was Egg, then the default will probebly be fair, but if it was Barclaycard, then as they admit they have no agreement whatsoever with you, and cannot produce one, then there is an argument there for a written complaint, they admit they did not pay due diligence at the time, so use that as leverage, you have nothing to lose by complaining.

The account was originally an Egg Credit Card taken out in 2006 and migrated to a Barclaycard in 2014. I never physically held a barclaycard and suspect I've just been paying an outstanding balance when it was left over from egg.

I defaulted in March 2018 with an outstanding balance of £702.00
You suspect? Don't you know when you spent the money?
How come you have never physically held a Barclaycard? Why were you not sent one in 2014?
