But he was constructive - He explained why it happened. The data held by insurance companies is vast, and it proves that there is a greater likelihood of an accident happening post an accident, regardless of fault - This can be down to increased nerves when driving, additional worry, or any other reason. It is a real phenomenon.0 -
My understanding is that this has been tested in various courts but generally the damages are not recoverable as they are deemed too remote, or these are considered to be a claim for "pure economic loss." A few jurisdictions do allow recovery of increased premiums, though not England and Wales as I understand it. Proving a quantifiable loss that flows from the damage would be quite difficult in practise. Would be interesting to hear from a practising solicitor on this though.Lloyds broker working in Private Clients and Property Owners.

Yes you can claim this as a loss. I did it back in 2012.
You need to first show what your loss was and that you took steps to minimize it. One way you can do that is to use a comparison site and do quotes with and without he incident. Be sure to buy the one with it on!
Then you can write to the at-fault party's insurance company and tell them you are adding the difference to the loss you suffered and giving them 21 days to pay out.
I got about £250 back over four years.0
