Yes I very much doubt if our landlord will
throw us out, but we can’t afford to pay both rent and mortgage for more than 3 months, it will finish us.,,the tenants have a joint tenancy under 3 names.

But, I thought you have a rental guarantee from the estate agents?

I'm not really sure of the HMO rules, as I've always steered well clear. Could you please confirm whether the three tenants are related in some way?
No reliance should be placed on the above! Absolutely none, do you hear?

We have given notice to vacate our current rented property and there’s 3 weeks left of our notice period. But our landlady will be happy to extend I’m sure.

We have landlord insurance from Axa for buildings and contents but I’m not sure they will cover the breach of contract by tenants.

It’s not an HMO property, they are friends and co workers apparently. I don’t know if the rent guarantee will offer protection after the tenancy contract has lapsed( which is the case)

What breach of contract? If they are keen to stay on they will probably continue to pay rent. If that is the case they will not be in breach.

There is no such thing. They have stayed beyond the end of the fixed term. That being the case the tenancy continues either as a CPT or an SPT and rent is due.

Only a Court or a tenant can cause a tenancy to end.

Please read the stickies as previously advised.

But we want our property back,,we need to move back in.,,they can’t just stay on indefinitely.
We have already issued an end if tenancy notice to them( Section 21) and they have breached the contract by not vacating the property.

All an S21 notice does is warns the tenant that you are seeking to take possession of the property and will use the courts if necessary. The contract only comes to an end when the tenant leaves either of their own accord or on the order of the court. The one who is likely to be in breach of a contract and suffer the financial consequences is you as you have handed in notice for your rental, if you don't go you could be liable for double rent.
