Hi guys, have been reading through old threads and have read through the newbies thread.
I have also waited to receive my NTK before making a thread.
I am unsure in how to fight my case.
I received my fine for parking in a tops tiles car park, firstly I visited the store next to tops tiles, and then went into tops tiles after, I was only browsing so did not purchase anything.
When I went to my car I had a ticket.
As I was in a rush and had to leave I didn't go back into the shop, however I spoke to the manager and she was 'not' able to help.
I did take a picture of a brochure I obtained from tops tiles, next to the ticket that was my car at the time.
now my questions is, as the plaque on the wall states the car park is for customers, and I was a customer, but was also a customer of the shop next door, is this a valid reason for a ticket.
So do I fight this on the above points and declare myself as the driver, or go down the keeper route.

Complain to the CEO of Topps Tiles, strongly requesting cancellation. It shouldn't be too difficult to find out who they are. Do that straight away.
I admit I've been searching 'myparkingcharge.co.uk' on the board and am not yet 100% sure how to handle these things. Though I do think some dates will be required for clearer advice than I'm offering! What was the date of the parking event? And when was the postal NTK received?
Edit your post ASAP so as not to reveal the identity of the driver. That's really important as the parking companies lurk here.0 -
If they took this to court a judge might very well find that your visit to the next door shop was not a breach of contract but perfectly reasonable behaviour,

In any event, complain to your MP, it is imo a scam.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .

What are they claiming you did in breach of t&c? Overstay? leave premises? What do the t&c state on the sign.
You really need to give us some facts, including was it ANPR, windscreen ticket , when did the NtK arrive - how long after the event.
Without that lot, all we can really say is "Follow the advice in the Newbies thread"0
