Hello all.
I currently have bw legal chasing me on behalf of Britannia Parking.
I received a disappointing automated reply from Britannia Parking. I used the legalbeagle template, and in the section [ if there are specific things you want to know put them in here otherwise remove this] I wrote the following as per guidance in the newbie thread:
"Please supply the data about me that I am entitled to under data protection law relating to myself. Include all photos, all correspondence between the alleged offence and now. Also include specific details of all PCN's relating to your claim. "
I received the following email:
Dear Sir/Madam,
We have received your Subject Access Request, under ICO guidelines we have one calendar month to respond.
Please be aware we will send a copy of all personal data we hold only. If you have made a request for any additional information which does not qualify as personal data, please see below.
YOU’RE REQUEST FOR ADDITIONAL INFORMATION
Landowner agreement - You are not entitled to business sensitive information, it will only be supplied at court, as evidence and not before.
Contract with the driver - The contract is on the signage in the car park. A copy of the signage will be provided as evidence at court.
Machine reports - You are not entitled to transactions which do not relate to you, you will be provided with your transaction only. We are under no obligation to provide you with anything further.
Picture packs - A copy of the signage will be provided as evidence at court.
Your SAR request is free, however please be aware we are able to charge for additional copies and any requests for information which does not qualify as personal data. ICO guidelines advise we are able to charge a reasonable administration fee, which is £10.
Please send a cheque payable to Britannia Parking to the following address: Data Protection Officer, County Gates House, 7th Floor, 300 Poole Road, Poole, BH12 1AZ.
Include a list of the additional information you require and the PCN number/s. Once the cheque has cleared we will action your request. We will only send additional information which is not business sensitive.
Please refer to the ICO website for further information:
If you do not wish to pay £10, we are under no obligation to provide you with the information, your only options is to wait until this matter progresses to court, when it will be adduced as evidence.
Once you are in receipt of your SAR, all additional correspondence regarding the request for additional information will not be responded to, unless payment of £10 is received.
Should I respond to this email, and tell them they are wrong? What is my next step? I have also emailed bw legal regarding the SAR sent to BP.

any extra data should be provided under the PaP oct 2017 rules , not GDPR
a SAR only covers your data , nothing else

When you say they are going to provide said information, do you mean they will of their own accord, or do I have to harass them until they do as I ask?
Redx: That was the email to/from Britannia Parking; the last part of my post was perhaps unclear, I meant to say I had informed bw legal that i had made a SAR to Brittania parking, as per newbie thread instruction.0 -
BRIT always reply with that text, basically it means they wont provide anything for free EXCEPT for your own data
so pointless asking them for signage or landowner contracts etc, you may get them at the WS + EXHIBITS stage
you can ask B W LEGAL for those under the PaP oct2017
you need to make it extremely clear who is replying to what, because there are 2 requests that you put in motion, so dont ask for what you cannot get under a free SAR request
B W LEGAL will probably tell you they are not going to put it on hold
if you dont know what to expect, then you havent read enough threads on here0 -
I haven't requested most of the things the generic email mentioned, I asked only for photographs of the offence, correspondence and for the PCNs. Are those not considered personal data?
Like i said, I used the template from legalbeagles, and added the photo/correspondence/PCN requests, just as the newbie thread by 'coupon-mad' told me to do.
To summarise
I made a SAR request to Britannia Parking by email
I informed bw legal that I had made a SAR request to Britannia Parking by email
I received the email above in the original post
I don't know if to, and how to reply to said email

if BRIT have acknowledged your SAR with that template reply, then wait up to 30 days for your SAR reply0

What was the email address you used for Britannia Parking? I am trying to request a SAR from them too but cannot find one on there website?

Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0
