May I ask a few questions?

First of all I wish to say a big thank you for all of the advice I have received so far. It is most appreciated.

A quick recap of the situation. I received a Notice To Keeper through the post from the notoriuos Norwich Traffic Control , I appealed using the very handy template her on this very useful site. They stated that it didn't matter that I denied liability or not. As vehicle keeper I was liable for the charge. I have never named the driver and have no intention of doing so.

BW Legal have now informed me that unless I pay £160 by the 22nd of March they will take it to County Court.

So my questions are thus,

Do I need to name the driver? As far as I'm aware I am under no obligation to do so.

The site signage states that the driver is reposnible for the charge. So not the vehicle keeper? If they cannot prove who the driver was, can they force me to pay as vehicle keeper in County Court? Do they have to prove, beyond doubt, who the driver was?

Also I am planning to ask BW Legal for copies of the following documents. Do they have to provide them on request?

* A copy of the V888 form used to gain my personal information.

*A copy of the letter of consent from the landlord to peruse the charge on their behalf.

* A copy of the letter of consent from the DVLA to pass my personal details on to a third party. (Do anyone know what this form is called?)

* A copy of any evidence to the identity of the driver.

I have tried to log on to the BW Legal website to ask for this info, but cannot do so as the reference number is not recognised. A lot of people have said the same thing.

    What was the date of that letter?

    The driver is initiall responsible, if they do not know who that was, the keeper may be held liable. They can force you to do nothing, only a judge can order you to pay them. Have you read the stickies, all is explained there.

    Complain to your MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

    Is this to do with your existing thread? If so either ask a board guide to merge them or delete your post and amend the heading and content to say this is a duplicate thread and should be ignored.

    Most of the questions above are already answered in the NEWBIES.
    An SAR to the scammers will also give you some of the info you require.

  • The date is 15/2/19. They give until the 22nd of March as mentioned. Now I know that BW Legal cannot force me to do anything, they will make threats and insinuate stuff but it's hot air.

    The only way they can get me to pay is via a court order.

    Norwich Traffic Control has said that the landowner witnessed me park the car on site, I have asked for proof twice and they have ignored it .

    As far as I am aware I am entitled to see any evidence, but not sure if they have to supply copies of any documentation such as the V888 form etc as I cannot seem to get a straight answer anywhere.
    Do not give in to Private Parking firms. Fight them all the way!
