Landlady changed her mind about renting after signing the contract - Can I sue her?

    Then, in answer to your question "can I sue her?" - No, you can't. There was an Offer and an Acceptance, but no Consideration so there is no valid contract (it doesn't matter that you wanted to pay a deposit, in the end you didn't). With no valid contract, you can't sue her for breach of it.
    I'm sorry this isn't what you want to hear, but it is the Law.

    Have a read about promissory estoppel.
  • It isn't a case of I "don't like" your example - it's just nonsense and doesn't happen in the real world - and now you've given another non-existent 'example' of a sofa from DFS. Are you seriously asserting that DFS manufacture/order in items for customer orders without taking a deposit from them? Every item of furnishings I've ever ordered (sofa, carpet, curtains) has required me to pay a deposit with order, and balance on delivery. Your 'concept' doesn't exist.

    Yes - because that's exactly what they do. Just because it has never been your experience doesn't make it untrue.

  • Well good luck to the OP hiring a lawyer to argue promissory estoppel at Court - she'll pay out ten times in legal fees what she would ever hope to recover from the prospective landlord.

    I wasn't commenting on the OPs likelihood of being able to recover any losses, but on your assertion that a contract can only be valid if consideration has already changed hands.

    Have a forum search within the Consumer Rights board for those seeking to cancel their orders with DVD due to change of mind and read the responses - you might be enlightened.
  • I can only find two posts in the first 5 pages (of 1875) relating to DFS and they're both about faulty goods. What issue are you talking about? Link?
