    The driver won't be celebrating: his punishment will be a massive hike in his renewal quote.
    Yes, if you win then his insurers will have to pay your legal fees. and other costs. If you are 100% confident of winning then engage a solicitor on an hourly rate basis rather than a commission basis.
    A conviction for driving without due care and attention can result in a penalty of as little as 3 points, which in itself would not affect his premium at all.
    No free lunch, and no free laptop ;)

    Winning? He has accepted liability during police interview! I'm pretty confident.....

    The hike in insurance will be for a claim. A claim plus points would be a more suitable punishment for the incident.
    After a few hours of trying not to fall asleep he is done. 3-7 points on his license may see him modify his driving.

    3 points for speeding won't necessarily hike premiums too much. It does however mean for undue care.

    Apart from that, thanks for taking the time to comment.

    Easy to admit liability if that means next to no punishment.



    That doesn't mean anything. In fact it's likely that he would walk free from court, as the prosecution couldn't prove the offence beyond reasonable doubt

    How can you be so sure? Some education on how to drive properly might actually be what this driver needs.


    I wouldn't be too dismissive of a driver awareness course and so disappointed they didn't get points on their license.


    Neither of these are guaranteed to make a difference but for most people, the incident itself would hopefully serve as a stark warning.
