Assets collections CCJ

Hi I’m looking for advise I toke a loan out with avent credit few years back and ended up in Financial difficulty and fell behind on payments. They passed my loan over to a debit company which only contacted me by email which ended up in junk which I didn’t realise they have passed my debit on to tm legal They had been sending emails which had also gone into my junk when I have checked this I had one saying they was taking it to court if they didn’t hear from me so I have contact them in November and set a payment plan up of £17 per week. They told me to send court papers back and they will close the case they are still going ahead with this case and it’s now be referred to a court and I’m Awaiting a court date.
Will I end up with a ccj even tho there was a payment plan in place before they have taken it to the court and I haven’t missed a payment with them

  • Yes that's what the court papers are for.

    You need to post on the DFW board though for advice
  • You wont necessarily end up with a CCJ if you follow the Courts (Judge) instructions and the fact you can demonstrate you have a payment plan in place I would think it highly unlikely a CCJ would be entered against you.


    I think?? you can have a CCJ entered against you with a payment plan but its marked as 'Satisfied' whereas if you pay nothing it will be a 'Default' CCJ. Unfortunately whatever variant of CCJ you possibly end up with it WILL be on your credit file for 6 years so action from you is a must.


    Maybe find out more information from CAB, they seem to know what they are talking about in this area.
