Parking notice received 07/03/19
i have read the newbie post and understand i am dealing with PCM UK LTD who are a member of IPC,
i have lived in my flat for 3 years, Affinity Sutton now known as Clarion Housing adopted the above parking agency to monitor the car park without my approval 2 years ago, i have parked on the main road nearby and received damages to my car multipl times, and decided to park in the car park that was originally FREE for 1year, 8months without a problem, Clarion housing and PCM UKLTD would not let me purchase an additional Permit (reason we only do single permits)
i have originally appealed the additional permit by taking photos of all available spaces from 7am-8pm for 7 days at the start of the parking changes and provided the housing firm the proof that there was sufficient spaces and thus do not need a parking agency, they would not consider any changes.
please help on what i should, can do.

If rejected sit and wait to see if you receive court papers.
They have up to 6 years to issue a claim so make sure you inform PCM if you change address.0 -
What does your lease/AST say, or not say about parking and parking permits?
Does it say a third party scammer can issue charges?
Does it say a third party scammer can take you to court?
Your lease/AST has primacy of contract over anything a third party scammer says.
Complain to your MP about this unregulated scam.

For clarity.
You have one parking permit already and you are being denied a second?
If that is so who is using the first permit and do you have an allocated space in the car park? Or is it the case that a permit allows you to park anywhere in the car park?
Who owns the car park?
Do you own or rent your flat? As Fruitcake says what does your lease/tenancy agreement say about parking?
From what you say it sounds like that there wouldn't be enough spaces if every property had two permits so they are limiting it to one. We have one parking space per property and at the times you reference there would be empty spaces - but there are times when it is full. Not often but enough to matter.

Most residential complexes only allow a space for one car. Only in very up-market flats can you have more that one. All of my properties only have one, and in an HA block you are very unlikely to be issued one for your second car imo.
However, as they are a registered charity, complain to HM Charity Commissioners that one of their contractors is trying to cheat you. Also complain to your MP.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .You never know how far you can go until you go too far.0 -

How do they know who's got what permits? (The permit dose not have a reg on it) is impossible to trick them into a 2ed permit.
I personally I never given them my reg or my partners reg, is it possible to call them and say I have a new car and my permit is in my scrapped one. Get a new permit with my partners permit still being active? Surly they have no right to know my address and connect a permit with my address without my concent.

Sadly, the DVLA will happily oblige many of these scammers, and so they only need to apply to the DVLA to get details of the registered keeper.
In respect of the tenancy agreement, it is more about what it says about parking, and whether a third party can issue a charge/take you to court.
