    I've seen a lawyer do that in the past - typed 'we will not be billing our costs' instead of 'we will now be billing our costs'. That t cost them a lot of money :eek:

    I have no idea why they shut down

    I received a message saying that gym is temp closed because of H&S, and that is the sign on the door. However when I sent them a query asking when the work would be completed and the gym opened all I received was a terse sentence saying that gym is now permanently closed, no reason why was given

    It has been pointed out that I made a mistake in this post and I have updated the text to indicate that the gym is 'now permanently closed' instead of 'not permanently closed'

    This is the email that I received

    "Thank you for your email, unfortunately Apples Health Club is now permanently closed."

    So screenshot that reply from them and submit it with your section 75 claim to your bank/card provider as proof the contract has been breached and won't be fulfilled.

    And do make sure they do it as a section 75 claim - they sometimes will do a chargeback (whether on purpose or because staff dont know the difference, I don't know) even when specifically asked for a section 75 claim.

    However be aware that the s75 required chain (of debtor > creditor > supplier) can be broken by third parties if you didn't pay the supplier directly (it gets very complex so always best to avoid if possible).

  • Just had a response from my credit card provider. They are rejecting my section 75 claim.

    They said that without providing an invoice or contract they will not approve my claim.

    They told me that the only option I have left is to raise a complaint, which I have done.

    Is there anything else that I can do / be aware of when I go through this complaint purpose.

    To repeat, I used to pay for gym membership for myself and wife by monthly direct direct with a joint membership. The gym put up a poster offering 50% discount on monthly subscription if pay up front for a two year period. Once we did this, our monthly direct debit was cancelled.

    There was never any contract of this, or any invoice, just a poster that was put up in the gym.

    Go with the complaint, and if necessary escalate to the FOS,you might get your money back in the end and even if you don't it won't cost you anything.
  • Did you not get any paperwork (ie evidence) at all when you took up the 50% discount? surely you must have something to indicate that you paid up front for two years membership?

    How was the transaction listed on your CC statement? Who does it say the money was paid to?

    No, we received nothing from the gym. The only thing ever received was the credit card slip. All they told us was that they were going to stop our monthly direct debit after we paid.

    And when the first 2 yr period expired, I asked them if they would offer me a new deal, and the staff there verbally offered me the same deal as before. Pay for 2 yrs and get 50% off monthly membership.

    The transaction on my cc statement listed the name of the gym. It was not a 3rd party or payment provider ie WorldPay. I made sure of that before I started the claim.

    I am going to take this as far as I can because i think not having an invoice seems like a bit of a cop out. How many people keep their receipts, credit card slips.

    It feels to me like the stereotype you hear about with America health care, first stage is to reject the complaint to hope that person goes away.
