Aps legal and associates limited

My IFA has recently drawn up wills for myself and my wife. There is a clause which states that if either of my two named executors die before proving my Will then "I appoint in her or their place the directors at the date of my death in the company known as APS LEGAL AND ASSOCIATES LTD of Worksop Turbine Innovation Centre Coach Close Shireoaks Worksop Nottinghamshire S81 8AP and I express the wish that two and only two of such directors shall prove my Will and act initially in its trusts."

I don't know who APS Legal and Associates are. Is this is a safe clause to have in my will?

No! What it means is that they will charge a fat fee to be executors when you die. If you not already agreed a contract don’t and use a solicitor, cancel the will and get it done by a qualified solicitor NOT a will writer. How much do they want you to pay?

Your IFA is not an IFA. They might be a FA of sorts but they are not independent, and APS are a will writing company not regulated solisitors.

I would start again, get your will sorted via a local solicitor, and review the actual position of your FA because this is way out of the remit of an IFA.
  • Some of the directors of APS are listed as directors of 'Solicitors for Independent Financial advice' (SIFA), and other companies.
I read that wills, estate planning and probate may turn into the next big mis-selling scandal, I think it's already there.
