Hi there
I need some advice. I had an accident last year June, one driver hit me from the back when I was stationary in the traffic.
It has damaged my back bumper and door lock.
After all this time, third party refuse to pay and ask me to claim from my insurance as they have carried out independent check on the car and found that damage to my car and their is not consistent, I. E. That car is not broken. So they are saying it could be that I am lying and this could be a previous damage.
My car was taken by salvage and when I contacted my insurance they are saying that they can't pay from my insurance total loss as it is not tallying with the consistency report. :mad:
And got a letter yesterday from my insurance saying that other party will go for court proceeding for damage? ?
I need some advise on this please.

Let your insurer deal with the claim from the third party
If you dispute your insurers reason for rejecting your claim then your route to go down is a complaint in line with their complaints procedure
Then if you are unhappy with the response or they ignore you for 8 weeks you can escalate to the FOS for their adjudication all at no cost to you0
