Good to have a positive stance and belief. PPCs don't like people to take up a firm position against them, being institutionalised bullies, they much prefer cowering wimps.

Glad you seem up for the fight. In the main (but there have been exceptions), Judges aren't fools.

If court papers are issued, the more you fight via a well prepared and solid defence, subsequent well written Witness Statement and strong evidence, the more likely they will back off.

Do a forum search on keywords 'Britannia BWL discontinuation' to read cases that are coming to light. You could also substitute 'Britannia' for 'NCP' who have also recently jumped into bed with BWL in issuing court claims (pressure tactic as described by me above) on an industrial scale.

HOW TO USE THE FORUM SEARCH FUNCTION:

Hit your 'Back' button to get back to the forum thread list. On the bar just above the threads you'll see the 'Search' function. Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.

:T I'd just like to say thanks again for your valuable help and advice. Really appreciated.

I would say we are more than willing to stand our ground, but as I said, we really don't need the hassle. How dare these scroungers illegitimately demand £100 and more from a hard working family struggling to pay the bills? Shameful.

These companies and their staff literally seem to have no compassion or morals.

Thanks again. Keep up the good work in fighting these crooks!

Complain to your MP. Popla are far from impartial and some of their decisions fly in the face of reason.

IIMU that many of the so-called adjudicators are newly qualifird law graduates who have been uanable to find a place in a law firm or chambers.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .

Was very much the case with 'old' POPLA (London Coucils), but the current POPLA has more reliance on former call centre staff, ex-nail technicians, and a budding soft !!!!!! author.

London Council adjudicators, once the got the hang of things, rarely produced decisions that were legally flawed. Not so much the case now in sunny Warrington.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If POPLA were to have professional assessors, you would be right but, that is far from the case. Just be glad that their decision can be ignored by you as it is not legally binding

I get what you're saying, but logically this seems odd - if I understand correctly. So POPLA decisions only hold weight with successful appeals. Is this the case? i.e. So if POPLA rule in favour of the appellant, the PPC void their claim; but if POPLA rule in favour of the PPC, the appellant cannot argue their statement.

Maybe I have the wrong end of the stick, but surely if POPLA are adjudicating the appeal, how can their statement and decision not be part of any legalities?

In our scenario the POPLA error should actually help our case in theory. I now know, thanks to you on here, that it makes no difference, which was my initial query.

Either way, it is what it is. Fingers crossed that Britannia drop it...

Thanks and I agree entirely! Absolutely shocking industry.

If I can stall Britannia until Easter this could work in my favour :rotfl:
