Reclaim overpaid council tax

  • My property wasn't built until 1994 so how can I check what it was worth in 1991 in order to follow through the process to check I'm in the correct  band?

    Do not think it was worth anything in 1991 as it had not been built at that time??  :*

    Very difficult, as 1991 prices are not in the public domain. Are other nearby houses in the same band as yours?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Very difficult, as 1991 prices are not in the public domain. Are other nearby houses in the same band as yours?
    2 other things come to mind

    1. If the house is on an estate and as it was built in 1994, there is a good chance there has been an appeal on a similar house.

    2. If you can find out the 1994 price, add 25% and it will give you a rough idea of the 1991 price.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • we have tried to claim a council tax refund a few years ago as the house next door has 4 bedrooms we have 3 bedrooms both houses are on the same tax band . The council informed us that the property next door would not be rebanded  untill the property is sold . Is this correct  or can we claim anything back.

    It is perfectly correct that if the house next door has had alterations carried out by the current owner, the CT band cannot be increased on account of these until the house is next sold. It is also perfectly possible that a 3 bed house and 4 bed house can be in the same CT band.

    Following last nights programme with Martin Lewis a thought occured about my parents and their current situation regards Council Tax. Dad had a stroke 4yrs ago and Mam has been registered as having dementia, it seems after watching the programme that they are entitled to no longer pay any Council Tax, if I'm correct, can i ask how to proceed going forward?
  • Answering my own queries it looks like the Local Council website has options for checking.

    Two possibilities - Council Tax Reduction or the SMI disregard (leading to an exemption). This assumes all qualifying criteria are however met.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Sadly this time I was unsuccessful.  I did not try and reclaim overpaid council tax until I realised many years later that I was paying the same as the houses either side of me which are 5 bed/double garaged.  The council would not let me go to tribunal so I saw my MP’s office instead who did all they could to help as they knew staffing at the top of the tree so to speak.  My house is mirror imagine to the house at the back of mine.  Sq footage etc identical but the council came back each time with an excuses like mine was better in quality and dearer to purchase.  In the end the MP’s office was told no more could be done and that was the end of the matter.  So after being ripped off by the council for 10 years we are moving.  It is good to hear of the success stories mind you and wish mine was one of them but sadly not.
