New Generation parking and dcbl letter

Good morning all

I went to visit a friend and I think I have mistakenly not put a ticket on my car as the estate barrier was up and I have driven straight through but I can't be sure as this was in January. I received a letter from new parking which I ignored as suggested. They only send a picture of the back of my car... Which was also perfectly parked inside a bay! Now I have received a letter from DCBL stating I need to pay £160. On the reverse of the letter it states that it is not a high court or bailiff agency case. I have tried to read around this but don't understand what it all means...

My mum is scared that bailiffs will turn up and take things from our house.... Should I pay as I don't think there was a ticket....

    First, edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. ;)
    The Keeper has protections in law that The Driver does not.

    Do this before you do anything else.



    The advice to ignore has not been suggested on this site since the law changed in 2012, so I'm not sure where you got your old, inaccurate, out of date advice from.

    The sticky thread for NEWBIES was just underneath where you clicked on the newthread.gif button. It asks you to read it before starting a thread.

    It looks like this.

    Post 4 of the NEWBIES explains why it is safe to ignore debt collectors.

    Bailiffs cannot arrive at your door unless you have been to court, lost, not paid, had a court judgement awarded against you, and not paid that.

    All debt collectors can do is send you poor quality bog paper.

    I suggest you now send the blue appeal template from post 1 the NEWBIES. The scammers will probably reject it for being too late, but these are made up rules and you would at least be able to show a judge you tried to resolve this if it ever came to court.

    If the barrier was up when the driver arrived and no ticket was given, then this constitutes "frustration of contract" which would be a valid point to put in front of a judge.

    Where did the alleged event take place? If this was a place of residence, what does the lease/AST of the person being visited say or not say about parking?

    Please complain to your MP about this unregulated scam, and get the person being visited to complain to their MP as well. This is the only way this will ever get stopped.

    The letter says ... "On the reverse of the letter it states that it is not a high court or bailiff agency case."

    You don't owe £160. it's a fraudulent £60 add on by DCBL

    You should not have ignored the ticket, you could have appealed.

    Find out what the parking arrangements are and the signs in the car park and come back here

    This is not the stuff of that reality TV show. DCBL are not acting as High Court enforcers, and can be safely ignored, het are in this instance just low level debt collectors.

    The PPC are trying to scam you out of £60, DCBL operate on a no win no fee basis. In fact the PPC are probably trying to scam you out of the £100 as well. Get your MP on board.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

    Search the forum for DCBL and you will see their letters discussed.

    This is NOT a case where DCBL can come knocking, but their letters are misleading. You will also find some recent posts about 'DCBL Legal' who threaten court claims.

    But hopefully you know from the NEWBIES thread that we win 99% of defended cases.
