Hi,
I need some advice about a letter I received end of last week from Lowell solicitors about a ccj entered against my name since June 2014. The letter which my surname has been written with an extra letter in the middle states about payment for the ccj which I was never aware of before was for phone contract with Orange for £1018. The only contract with orange I had ended in 2009 and never owed anything to them or missed any payment to them. I have never checked my credit file but checked when I received the letter to see the ccj registered to my credit file but still have the misspelling of my name. I have never received any ccj notice about this or from Lowells although I have lived at my current address for 11years. I do have issues with my debts which I have dealt with and stop ccj before but know nothing about this one. Can anyone suggest what I should do with this, I was thinking the following:
1) Contact the claimant and ask for more information about the original debt since I know I do not owe anything to orange.
2) Apply to court to have it set aside since I never knew about it and defend the case to ask for more evidence about the contract and so on.
I would really some advice on the above. Many thanks

I would go for option 1 and take it from there. If it turns out it wasn’t you and you can prove this then Lowell will happily stop enforcement.
You could go to option 2 but this costs and it’s a little more stressful plus you need quite a bit of evidence to prove you didn’t receive the correspondence.
If you are 100% sure you didn’t take any other contracts out other than the one in good order, alongside the misspelling of your name suggests Lowell has either got the wrong person or it’s fraud, most likely the wrong person.
Ask Lowell to look into it on your behalf, they will pause enforcement whilst they are investigating.0 -
A tip for dealing with Lowell... be polite and explain everything to best of your knowledge and I can guarantee they will be helpful and understanding in return.0

Many thanks for advice. I’ll try contact them today. I am sure I myself never taken any other contract from Orange except the one which ended with no default. I’ll update the thread once contacted them.0

No worries! Good luck, just remember to not worry to much about it, debt can easily over burden the strongest of people.0
