Highview Parking Notice Honest Mistake

Hi All,

Searched for this but couldn't find a similar result with a procedure.

basically received parking notice of my car in car park in England (Car is registered in Scotland, currently living in England for work short term).

Parking was 100% paid for on Justpark. receipt is available. however the caveat is that my friend I am living with who used the app to pay accidentally used their vehicle reg details, all times and dates corelate. just vehicle is wrong..... got the whole letter with pictures of my car entering exiting etc.

this is an honest mistake in my eyes, and I do not plan on giving away money for an honest mistake when the service had actually been paid for. any advice on how to proceed, the standard appeal letter doesn't seem to fit with this but could be wrong here.

    Just use the standard appeal you found in BLUE text in the NEWBIE section without additions, deletions or modifications. Appeal as KEEPER.

    Just appeal using the initial appeal template (the only one in blue text) from the newbies FAQ sticky, post #1, and HV will cancel in a couple of days.

    Do not add anything to the appeal. Follow the process of appeal as detailed by HV in their paperwork, but be wary of the drop down box on their appeal portal that you need to tick before submitting. You are appealing as the keeper, that box defaults to 'driver'. Be careful it's showing keeper before pressing the submit button.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

    For clarity. on appealpcn.co.uk do you mean to say that you were not the driver and the pcn received contains incorrect information?

    I don't really feel bad about this is I feel like I did pay for it anyway. just a mixup

    I believe that box says you "were not the driver OR the PCN contains incorrect information." Just make sure that the form does not revert to it's default position of DRIVER, you are appealing as KEEPER, i.e. not DRIVER.

    so they are writing to an address in sunny scotland

    ask them if they can identify the driver , to ask him to return it

    Hi All,

    Once again thank you ever so much for your help, hopefully this thread is not buried!

    I have yet to post the appeal, I wanted your thoughts on an adjustment... Please let me know if this is ok or not... I do actually have this evidence

    Below I have added the generic response with evidence of the drivers bank statement with the charge to highview parking. (not the registered keepers bank statement who was not driving the car)


    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

    - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

    CHANGE IN HERE

    Please note: the DRIVER of the vehicle has forwarded on a banking statment to myself the REGISTERED KEEPER that shows parking has been paid for on the premises by THE DRIVER, you can find this in the evidence section.


    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

    Do not under any circumstances alter the template. It tells you not to for a reason.

    I understand, I read on and it says you can carefully alter, this is me trying to do that

    "You can (carefully!) add a little to the template above, 'in order to resolve the dispute I attach copies of...':

    - the driver's receipts/bank transactions (or Hospital Appointment/Hotel booking, etc.) that day as 'they' were a genuine customer/patient, etc."

    Unless this means to say that the driver was nowhere near where the offence was, in which case I misunderstood.

    I have the letter with pictures of the vehicle and statement there is no evidence of a sufficient payment being made. letter also states something regarding parking eye vs beavis... I do not have any of the PDT / VRN data as stated in standard response which I plan to use.

    It's only Highview. They will ask who was driving, ignore that, if they do.

    Then they will give up.

    No need for any threads, let alone amending the template.

    Easy target practice for you.
