Heath Parade Colindale Fiasco

Hi all
my first post sadly as I should have posted months ago.

I was photographed at Heath Parade in Jan 2018 by the woman with a camera when stopped to collect my daughter for 1min 20 secs. Having googled the place about this I saw that someone - I cant find him now - had defended the case by showing that PCM - the parking authority - did not even have a contract in place with the actual freeholders of the property. Therefore I decided to go to court. However I never even put a witness statement in for my defence - I have never been to court - I naively thought i would be able to wing it by stating these cases. It took place on Monday 25th Feb.

Ofcourse the judge said I needed to bring in my own evidence not rely on another case. So - I think - she asked me to pay the solcitors costs for a day £154 - Im not even sure who to pay and reeled off another two dates, 18 Mar I must submit my evidence supporting my claim, and I think the 15th April we need to reconvene.

I was in a bit of a daze thinking I have bitten off more than I can chew.

So now could someone tell me if
1. I am going to get a bill for the costs from someone ,
2. will I get a letter from the court stating what the judge said and when and where the hearings are,
3. has anyone got the contacts of the person or persons who have sucessfully defended a claim here on the basis of no contract between PCM and the owners of the property
4. I see that people have talked about grace periods, and bad signage, can I now use this in my witness statement.

Its all getting a bit much and I do so wish I had paid the £60 and be shot of it. Whatever happens now its going to be a lot more.

    You should receive a letter with the directions of the court, effectively saying what you pay and by when and by when you must submit your defence. If you don't get one in a couple of days, phone the court, quote your case reference number and ask when/if you will be getting a letter. If no letter is to be sent, can someone tell you what the judge ordered.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

    I have just received the letter

    It goes like this
    It is ordered that

    1. the defence struck out.
    2. the defendant by mar 18th file and serve an amended defence and counterclaim
    3. in default the claimant is at liberty to enter judgement
    4. the defendant shall pay claimants cost of £156 by 18 Mar
    5. Permission to claimant to file and serve reply to defence by 1st april
    6. Either party to notify the court by 15 April if further discussions or a hearing is required.

    So my questions are
    1. I need more time - my daughter is getting married next month - who do I ask for an extension?
    2. There are no addresses or forms with the letter so where I should send my defence.
    3. There is no invoice for the £156 - who do I pay?
    4. there are so many links on this issue so which Which defence is the best defence ?

    You really do need to read the NEWBIES thread, specifically post 2 about defences etc.

    I may be way off mark, but I would be amazed if the court would entertain an extension. You have two weeks to craft a defence - plenty of time. And it looks like the court may have been generous in allowing this in the first place.
    2. Read the NEWBIES post, but hint: The court and the claimant need a copy each.
    3. Get in touch with the Claimant or their solicitors - email them for confirmation.
    4. Read them all. You will see there are themes across all of the defences. You will want to include many of them (e.g. signage, contractual issues, POFA compliance, landowner authority etc etc). Seriously, YOU have to put the work into doing this.

    Oh, and, if you haven't done so already, you need to submit a subject access request to PCM and the DVLA. There's a template link in the NEWBIES thread (takes you to Legal Beagles). The data protection officer's email address will be on PCM's privacy page. Get that done today if you haven't done so already.

    Don't you know? She was probably annoyed with you for wasting court time. All of the questions you have asked and answered in the stickies or on google, why are you are asking Us? n

    When you get a court claim you must follow the procedures to the letter. Failure to do so has cost your dearly already.

    If you want to avoid paying this, and perhaps get a CCJ, you must treat this much more seriously than you have done so far.

    You are being summoned for an alleged debt, the judge will expect you to prove to her that you do not owe it.
    You never know how far you can go until you go too far.

    I think I have found the link and template but as I have to file my defence by the 18th Mar I dont think an SAR is going to help me now or if Gladstones will respond anyway.

    I have a detailed witness statement from the lady in sunglasses as it is with pictures of the signage etc.
