Hi all,
I was given a windscreen parking charge notice from f1rst parking, for parking without a permit or daily pass. I then received another one two days later for parking in the same car park. I had only parked there for less than 20 minutes both times! I've been reading through a lot of forums trying to work out what to do next but I'm still unsure. As they're a member of the BPA, am I correct in thinking that I should wait until day 26 and then send in an appeal? but I'm unsure what to say in the appeal? Or should I just not respond?

appeal as KEEPER on day 26, then hope they fail to send an NTK by day 56
use the blue text appeal as keeper, no blabbing about who was driving
they will probably refuse the appeal and issue a POPLA code0 -

Complain to your MP. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .You never know how far you can go until you go too far.0 -

If you are not the driver at the time, please tell us who was driving. If you are unable to provide the drivers name and valid address and the amount remains outstanding after 28 days, the Creditor has the right to recover unpaid parking charges from the registered keeper as described under Schedule 4 of the Protection of Freedoms Act 20120 -

OF COURSE YOU DO NOT ADMIT TO BEING THE DRIVER!
There must be a way to appeal without ticking that box as they are not allowed to make an appeal conditional upon saying if you were driving or not. No-one else has posted that this is a problem with F1rst.
Try to see if you can get past it without ticking it, or does it in fact have a longer sentence like: 'I was not the driver or the PCN was issued wrongly' (which clearly is OK to tick and is not lying, due to the word 'OR').It also says this:

No they don't. Not if you appeal on day 26/27 and they forget to issue a NTK!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Tick "no" and if it gets to court tell the judge, (but only if he asks), l that the choice was unlawful. There is no requirement to in law to say who was driving.

You are dealing with scammers. Having no option to appeal as keeper is just part of their scamming technique.
The advice is never to reveal the driver's identity unless it is to the motorist's advantage, such as an own space residential case.
Your posts throughout this thread are littered with information about who was driving. Note that parking scammers monitor this forum and it would only need one small piece of information such as a date or precise time and the scammers can link a post to an individual, and therefore have proof of the driver's identity.
That's why posters are advised to refer only to The Driver and The Keeper on this site except in very specific circumstances.

My car was parked on “cross-hatched area” today and issued with a £75 fine, £45 if paid within 14 days or £25 if paid within 24 hours.
This car park wasn’t a pay and display area. My car was parked in between 2 disabled parking spaces but not blocking anyone in.
3 other cars were giving a parking charge notice for parking on “landscaped area” close to me.
Where do I stand with this?
