Car Finance contract issue
Hello all,
long time lurker now first time poster, some help would be appreciated and hopefully I can do the same in future for others.
Basically, I agreed a price over the phone with a main dealer and paid a deposit over the phone for a car. Price agreed on the phone was £170 per month for 60 months. Deposit paid was £500, which the dealer said I would get back.
When I went to pick the car up, the paperwork said £180 per month. I challenged this (albeit weakly) and they looked me dead in the eye and said they are confident it was 180 and not 170, and that was not the conversation I had with the finance guy. They also said all calls are recorded (which was to my advantage). I doubted myself due their confidence display and so signed the contract.
Having had 2 days away, I am 100% certain the contract I was their to sign was for £170p/m and not £180p/m. Also the receipt on the deposit says non refundable.
I am 100% on the phone call the dealer said my deposit was refundable and that the deal was for £170p/m.
How do I get my original deal (this was 2 days ago). I called the dealer (main dealer) but no answer. The calls are recorded can I use that in any way to explain clearly the deal I came for was for £170pm not £180pm as the deal presented to me based on their confidence is incorrect and to revert me or refund me the difference between the 2 contracts (£600 over 5 years).
Kind regards,
FC

Why did you sign then?
If the paperwork said £160, would you be saying you still want to pay £170?
The time to challenge was when the paperwork was in front of you, not days after the event.
I'm not sure you have a way out of this, now that you have signed the paperwork, the contract is proof of what was agreed, if it didn't match what was actually agreed then you should have said.
"All calls are recorded are they? Excellent, I'll wait while you go and confirm your error and print an amended contract"
What was the price of the car and the APR?0 -
"All calls are recorded are they? Excellent, I'll wait while you go and confirm your error and print an amended contract"
Would it not be on the car company be admit they too were wrong, and should offer me what was agreed by THEM ALSO the phone? If what we agreed was recorded surely they have to also admit to presenting incorrect information.
As I said, I should have been more confident and not doubt myself in the moment.0 -
Problem is, they are not going to admit they are wrong as they have a legal document that has been checked, verified and signed by you.
Try and call them and get the call recordings, then see what they say0 -

But you agreed to a non refundable deposit and £180 a month when you signed the contract. Why should they refund you?0 -

suppose this is my only option, I am hoping they can admit that the recordings show that was agreed and they should do the moral/honest thing (if there is such a thing) and go to the original deal.0 -
I see the brutal cold 100% logical view of 'yes you signed you muppet so tough s**t'.AndyMc..... wrote: »But you agreed to a non refundable deposit and £180 a month when you signed the contract. Why should they refund you?
I suppose from a ethical/honest/ treating customers fairly point of view, if there is a verbal recording of them offering me the £170 with my deposit taken in relation to that £170 deal with the receipt on that date the £170 deal was verbally agreed, then surely they would have to admit it was an error and revert to that verbal deal agreed?
yes I know, and admitted I should have been more confident in the situation.
Yes it is a hastle for them but the right thing to do is to honour the verbal agreement.
Surely they've dealt and bent over with a lot worse?!0 -

You agreed to the new deal and can't prove the old one existed. No doubt you'll be back later saying the dealer reversed the deal.0 -

If I get the recording of the telephone call that does prove the old deal exists (dealer says all calls are recorded), this means I can prove the old deal existed. I am hoping that the proof of this would mean the new deal signed was incorrect and should be rectified.
thanks,0 -

thanks,
Yawn.... as others have mentioned what is signed is what you have agreed to, if you didn't agree then do not sign, I wonder if there is some insurance levy at 5% which you may not have considered?0
