Help..please..Wife got CCJ at old address due to unpaid PCN.

Hi,
After some googling I was kindly pointed to this forum. My wife recently found out that she has a ccj on her credit report. We looked into it and it appears to have been sent to an old address and we didn't get the chance to respond. I have read in some of the threads in this forum that this would not be sufficient reason to set aside the ccj.
My wife lent her car to a friend, and the friend managed to park on double yellow lines outside our old address. The friend 'forgot' to mention it and we received some letters about the PCN, we kindly passed these on to said friend to settle this matter. Clearly this did not go to plan, and due to us moving out of the old place we never received any other letters. So, now she's stuck with a ccj, but the friend said she will do whatever it takes to help remove this ccj from my wife's file. If anyone could possibly help with this, we would be really grateful.
Many thanks.

look at the newbies faq sticky thread where there is advice on this
look for the £255 which is what it will cost to go for the set aside, and the 6 point example on what to ask
plenty of previous threads on here about this so read those too, plus your wife will have to defend the original claim if the claimant decides to continue with it, so she will also have to try and win and then ask for costs including the £255 back
so its a lot of work, so be under no illusions, and a set aside is not guaranteed , so it could cost £255 with the original charges still in place as well (the CCJ) - its not a given that she will win or that a set aside will be granted, the £255 is to ask a judge to consider a set aside
which PPC issued the pcn ?0 -
See the end of the 2nd post on the thread called:
newbies please read these faqs first (that is not a link, you don't need one)
...where set asides are explained. The NEWBIES sticky thread is at the top of this board.
If your wife has a lowish income (look the court help with fees rules up) she can apply to set it aside free, otherwise it's a £255 court fee which, possibly, can be reclaimed from the scammers.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
Thank you both very much for your speedy response! I will read through the stuff you pointed out. If I have further questions, is it still ok to post on this thread and ask?
To be fair I hadn't realised that it would be a long process, in my simple mind I thought that she had a ccj wrongfully placed against her name and it needed correcting. I have quickly come to terms that this does not appear to be that straight forward.
The PPC used to be called Coast2Coast, I believe they're called one parking ltd now. I will double check with my wife and confirm the name.
Once again, many thanks for you help!0 -
It's not the quickest process in the world, but to give you context, I applied for my set aside on 14th Jan, and had my set aside hearing on 27th Feb in Exeter. I didn't think that was too bad.
You would be well advised to send a Subject Access Request to the PPC and DVLA. This will help you know exactly what was sent, where and any pictures that they have regarding the PCN. The email address to send SARs to is usually on the PPC's privacy page. A link to the Legal Beagles SAR template is on the NEWBIES thread. They have 30 days to respond to your request.Natwest OD - Start: £1,500 Current: £1,500 | Creation Loan - Start: £2,152.33 Current: £2,082.90 | Barclaycard CC - Start: £5,242.42 Current: £5,416.45 | Novuna Loan - Start: £8,598.43 Current: £8,366.04 | Tesco CC - Start: £9,420.22 Current: £9,885 | Northridge Car - Start: £15,584 Current: £15,017
