    I was just asking if before I started to amend this would it be a viable approach to creating a defence? Or is this an ok template to begin to use?

    What about bye-laws? If the land is subject t bye-laws most of post 11 is redundant.

    You need to get a grip on this OP, you must understand the issues if you are
    going to get the better a solicitor in court.
    You never know how far you can go until you go too far.

    That is a very long defence. It took me ages to find user Kelly 4509 because it is kelly 4509! User names are case sensitive. Defence is from 2017. Start with one of the concise defences posted by Bargepole and add other points to suit your case.

    I have looked into whether the car park has by laws and it does. I can't find information on what specific bye laws there are so I am not sure how this will help me.

    After talking to my phone company I have a 8 minute phone call to the car park operator to to where I bought a ticket and looking back at my account I have a payment leave my account 1 day later to Brittania themselves.

    Would it just be wise for me to just give them a call and explain they've made a mistake? or now the claim form has been sent to me do I have to see the process out?

    Nope that would be silly. NO PHONE CALLS.

    This is likely to be for a VRN error, so have you sent a SAR yet and asked specifically for the data fro the machine that relates to your car or a near match VRN?

    Britannia have cancelled court claims when people asked for a SAR, when the data showed a 'minor keying error' only.

    As well as sending an email to the DPO asking for a SAR (see NEWBIES thread) you need to acknowledge the claim if you haven't already and amend your defence to a more concise version (again, see NEWBIES thread).

    Could Britannia cancel this for me even though they have passed over the debt to BW legal?

    Yes, sent the AoS straight away so this has also been confirmed.

    The defence I posted I got from the newbies thread. I was looking to amend this one.

    Sticking britannia parking privacy into google will find it easily.

    It's towards the bottom of their Privacy Policy.

    But the NEWBIES thread says to Google the parking firm and the word 'privacy' and get the DPO email from their privacy page. This is basic stuff, the sticky thread covers it all.

    It also shows you an example template SAR, but you need to add a request for the data from the machine, as I explained above.

    I already said, we've seen more than one discontinued, yes, PURELY as a result of the SAR, by exposing the fact the error was minor, Britannia stopped the action.
